"Türkiye Cumhuriyeti Hükümeti ile Birleşmiş Milletler Yakın Doğu'daki Filistin
Mültecileri İçin Yardım ve Bayındırlık Ajansı Arasında Ankara'da UNRWA Ofisinin
Kurulmasına Dair Anlaşma" 21 Haziran 2025 tarihinde İstanbul'da imzalanmıştır.
1949 yılında kurulan ve bir BM kuruluşu olan UNRWA; yerinden edilen Filistin
mültecilerine eğitim, sağlık, acil yardım ve sosyal hizmetler gibi temel insani yardımları
sağlamaktadır. Ajans; Ürdün, Lübnan, Suriye, Gazze Şeridi ve Doğu Kudüs dâhil Batı Şeria'da
yaşayan yaklaşık 6 milyon Filistinli mülteciye yardımda bulunmaktadır.
Bahse konu Anlaşma ile Filistin halkının özellikle eğitim ve sağlık alanları başta olmak
üzere ihtiyaçlarının karşılanmasını teminen vazgeçilmez bir rol üstlenen UNRWA'nm
desteklenmesi, Ankara'da kurulacak Ofis ile UNRWA faaliyetlerinde Kafkasya ve Ortadoğu
ülkeleri dâhil bölge ülkeleriyle eşgüdüm yapılması ve ülkemizin UNRWA'nm bir tedarik
merkezi olmasına katkı sağlanması hedeflenmektedir.
Filistin davasına verdiği önemin bir göstergesi olarak Türkiye, lJNRWA'nm Filistin
mültecilerine yardımlarının devam etmesi için desteğini sürdürecektir.

Birleşmiş Milletler Yakın Dogu'daki Filistin Mültecileri için Yardım ve Bayındırlık
Ajansı nm (UNRWA), Birleşmiş Milletler Genel Kurulu'nun 8 Aralık 1949 tarihli 302
(JV) sayılı Kararı ile Birleşmiş Milletler'in yan kuruluşu olarak Filistin mültecilerine
yardım ve bayındırlık programları sağlamak amacıyla KURULDUĞUNDAN,
Birleşmiş Milletler'in Ayrıcalıklar ve Bağışıklıklarına Dair Sözleşme'nin 13 Şubat
1946'da Birleşmiş Milletler Genel Kurulu tarafından kabul edildiği ve Türkiye'nin 2
Ağustos 1950'de belirli çekincelerle katıldığı GÖZ ÖNÜNDE BULUNDURULARAK;
UNRWA'nın Birleşmiş Milletler Genel Kurulu tarafından verilen yetkiyi desteklemeye
yönelik faaliyetler gerçekleştirmek üzere Ankara'da bir ofis kurması için Türkiye
Cumhuriyeti ve UNRWA arasında istişareler gerçekleştirilmiş OLDUĞUNDAN,
DOLAYISIYLA, bundan böyle birlikte "Taraflar" ve her biri tek başına "Taraf olarak
anılacak olan, Türkiye Cumhuriyeti Hükümeti ("Hükümet") ve UNRWA tarafından
temsil edilen Türkiye Cumhuriyeti ile UNRVVA aşağıdaki hususlarda mutabakata

Tanımlar
1. İşbu Anlaşmadım amaçları doğrultusunda,
(a) ''Ev Sahibi Ülke" Türkiye'yi ifade eder;
(b) "Ofis" Ev Sahibi Ülkenin yazılı rızasıyla Ankara'da kurulacak olan UNRWA ofisini
ifade eder;
(c) "Ofis Başkanı", Ofisten sorumlu olan UNRWA çalışanı anlamına gelir;
(d) "Resmi Görevliler", 7 Aralık 1946 tarihli Birleşmiş Milletler Genel Kurulu 76 (1)
sa3'ib Lalarında belirtildiği üzere, yerel bazda istihdam edilen ve saat başı ücret alan
şahıslar haricinde, ııj'ruğuna bakılmaksızın bağımsız olarak Ofise hizmet etmekle
görevlendirilen tüm UNRWA personelini ifade eder;
(e) "Görevli Uzmanlar", görevliler dışında. Ofisin talebi üzerine pygöjî^adına görevi#;''''?'

i) İlgili diplomatik misyon veya konsolosluk makamı tarafından Kabul Eden
Devlete bildirilecek ve bu Devlet tarafından ulusal mevzuatına uygun olarak onaylanacak
eş;
ii) 21 yaşın altındaki evlenmemiş^çocuklar;
İÜ) Ev Sahibi Ülke tarafından tanınan bir üniversiteye veya yüksek öğrenim
kurumuna kayıtlı 25 yaş altındaki evlenmemiş çocukları ifade eder.
(g) "Genel Sözleşme", Ev Sahibi Ülkenin de taraf olduğu, 13 Şubat 1946'da Genel Kurul
tarafından kabul edilen Birleşmiş Milletler'in Ayrıcalıklar ve Bağışıklıklarına Dair
Sözleşmeyi ifade eder;
(h) "Yetkili Makamlaı-", Ev Sahibi Ülkenin Dışişleri Bakanlığını ifade eder;
(i) "Ofis Binaları", Ev Sahibi Hükümetin yazılı izni ile Ofis tarafından kalıcı veya geçici
olarak kullamlan bina veya binanın bir bölümünü ifade eder;
(j) "Ofis Arşivleri", görevlerini yerine getirirken Ofise ait olan veya Ofisin elinde
bulundurduğu tüm kayıtları, yazışmaları, belgeleri, el yazması metinlerini, bilgisayar
kayıtlarını, hareketsiz ve hareketli görüntüleri, film ve ses kayıtlarını ifade eder;
(k) "Ofise ait Mallar", Ofisin, görevlerini yürütmesi amacıyla, Ofise ait olan veya Ofisin
elinde bulundurduğu ya da yönettiği fon, gelir ve diğer varlıklar da dahil olmak üzere tüm
malları ifade eder;
(1) "Genel Sekreter", Birleşmiş Milletler Genel Sekreterini ifade eder.
Madde II
Ofisin Kuruluşu ve Yeri
1. Ofisin merkezi, 8 Aralık 1949-tarihli ve 302 (IV) sayılı Birleşmiş Milletler Genel
Kurulu kararı uyarınca UNRWA'nın görevini desteklemeye yönelik işlevlerin yerine
getirilmesi için Türkiye'nin Ankara şehrinde kurulacaktır.
2. Genel Sözleşme'nin 17. Bölümü hükümlere uygun olarak. Yetkili Makamlar, Ofise
atanan Görevlilerin isimlerine ilişkin olarak düzenli aralıklarla bilgilendirilecektir.
Madde III
Tüzel Kişilik
1. Ofis, Ev Sahibi Ülkede tüzel kişiliğe sahip olacaktır. Ofis aşağıdaki yetkileri haiz
olacaktır:
(a) Sözleşme yapmak;
(b) Taşınır ve taşınmaz mal edinmek ve bunlar üzerinde tasarrufta banmak;
(c) Yasal işlem başlatmak.

2. Ofis, bu Anlaşmanın anıaçları doğrultusunda, UNRWA Ofisi Başkanı tarafından temsil
edilecektir.
Madde IV
Anlaşmanın Amaç ve Kapsamı
1. Bu Anlaşma, Ev Sahibi Ülkedeki Ofis Binalarının, Resmi Görevlilerin ve Görevli
Uzmanların statüsünü düzenler.
2. Bu Anlaşma, Ofisin görevlerini etkili şekilde yerine getirmesi için gerekli
düzenlemeleri belirler.
Madde V
Genel Sözleşmenin Uygulanması
Genel Sözleşme, Ev Sahibi Ülke tarafından söz konusu Sözleşmeye koyulan çekincelere
halel getirmemek kaydıyla. Ofis ve Ofise -ait mallar, fonlar, varlıklar ile Ev Sahibi
Ülkedeki Resmi Görevliler ve Görevli Uzmanlar için uygulanacaktır.
Madde VI
OHsin Dokunulmazlığı
l.Ofıs Binaları dokunulmaz olacaktır ve Ofise ait mallar, fonlar ve varlıkların, nerede ve
kimin elinde bulunduklarına bakılmaksızın. Genel Sözleşme'nin II. ve III. Bölümlerine
uygun olarak bağışıklığı bulunacaktır.
2. Ev Sahibi Ülkenin hiçbir memuru veya yetkilisi ya da Ev Sahibi Ülkede kamu görevi
icra eden hiçbir şahıs, UNRWA Ofisi Başkanının rızası olmadan ve onayladığı koşullar
haricinde herhangi bir görevi yerine getirmek üzere Ofis binalarına giremez.
3. Bir yangın veya derhal koruma eylemi gerektiren diğer acil durumlarda, UNRWA Ofis
Başkanının binaya girilmesi için gerekli olan rızası, kendisine zamanında ulaşılamaması
halinde alınmış sayılacaktır.
4. Ofis Binaları, Ofisin yukarıda II. ve IV. Maddelerde belirtilen amaç ve kapsamına
aykırı şekilde'kullanılamaz. Ofis Başkanı ayrıca, Ofisin görevlerine uygun şekilde, Ofis,
Birleşmiş Milletler veya diğer ilgili kuruluşlar tarafından düzenlenen toplantı, seminer,
sergi ve benzeri etkinlikler için Ofis binalarının ve tesislerinin kullanılmasına izin
verebilir.
5. Ofis Arşivleri ve genel olarak Ofise ait veya Ofis tarafından kullanılan mevcut tüm
belge ve materyaller Ev Sahibi Ülkede nerede bulunduklarına bakılmaksızın dokunulmaz
olacaktır.

Madde VII
Güvenlik ve Koruma
1.Yetkili Makamlar, Ofis Binalarının güvenliğini ve muhafazasını sağlayacak ve Ofis
Binalarmdaki huzur ve sükunetin, kişi veya grupların dışarıdan izinsiz girişleri ya da
yakın çevredeki karışıklıklar nedeniyle-bozulmamasını temin etmek için gerekli özeni
gösterecektir. Yetkili Makamlar, Ofis Başkanı tarafından talep edildiği takdirde,
Binalarında veya yakın çevresinde kanun ve nizamın korunması ve kişilerin
uzaklaştırılması için gerekli koruma ve yardımı sağlayacaktır.
2. Yetkili Makamlar, Ofisin talebi üzerine, bu Anlaşmada belirtilen şahısların, resmi
görevleri ve çalışmalarını yürütmeleri esnasında, Ofisin işlerini her türlü müdahaleden
uzak gerektiği gibi yerine getimeleri için zaruri olan güvenlik, emniyet ve muhafazasının
uygun şekilde temini için etkili ve yeterli tedbirleri alacaktır.
Madde VIII
Kamu Hizmetleri
1. Yetkili Makamlar, Ofis Başkanının talebi üzerine ve Hükümetçe herhangi bir akredite
diplomatik misyona sağlanan şartlardan daha az avantajlı olmayacak şekilde. Ofisin
ihtiyaç duyduğu altyapı, enerji ve iletişim hizmetleri gibi ancak bunlarla sınırlı olmayan
kamu hizmetlerine erişimini kolaylaştıracaktır.
2. Yukarıda VIIL Maddenin 1, Paragrafında belirtilen-durumlarda, Yetkili Makamlar
tai-afından sunulan ve fiyatları bu Makamların kontrolü altında bulunan kamu
hizmetlerinin ücretleri, akredite diplomatik misyonlar için belirlenen en düşük
karşılaştırılabilir ücreti aşmayacaktır.
3. Yukarıda belirtilen hizmetlerin tamamen veya kısmen kesintiye uğraması sonucunu
doğuran mücbir sebep durumunda. Ofise faaliyetlerinin devamlılığı için Ev Sahibi Ülke
tarafından herhangi bir diplomatik misyona tanınandan daha az avantajlı olmayacak
şekilde öncelik sağlanacaktır.
4. VIII. Madde hükümleri Ev Sahibi Ülkenin yangın koruma veya sıhhi düzenlemeler için
aldığı önlemlerin uygulanmasını engellemeyecektir.
Madde IX
îlctişim Kolaylıkları
1 Hükümet, kullanılan iletişim aracı ne olursa' olsun. Ofisin resmi iletişiminin
dokunulmazlığını güvence altına alacak ve söz konusu iletişime'herhangi bir sansür
uygulamayacaktır.
2. Ofis, resmi haberleşmesi için posta, kablo, telgraf, teleks, telef^g^^telgfon ile basın ve
radyo enformasyonuna yönelik diğer iletişim ve basın ücretleri ^fK^^ğu|anât^öncefi

oranlar ve vergiler konusunda Ev Sahibi Ülke tarafından herhangi bir akredite diplomatik
misyona sağlanan avantajlı muameleden yararlanacaktır.
2. Ofis, yazılım ve diğer programları, telekomünikasyon dahil olmak üzere iletişim
ekipmanını (yazılı veya sözlü bilgi, görüntü, ses veya her türlü bilginin kablo, radyo,"
uydu, optik, fiber veya başka herhangi bir elektronik veya elektromanyetik yol
marifetiyle yayımlanması, aktarımı' veya alınması) işletme, kod kullanma ve
diplomatik dokunulmazlık ve ayrıcalıkları haiz kuryeler ve çantalarla evrak gönderme
ve alma hakkına sahip olacaktır. Çantalar görünür şekilde UNRWA amblemi taşımak
zorunda olup, sadece resmi kullanım amaçlı belge veya eşyaları içerebilir ve kuryeye
UNRWA tai-afmdan düzenlenen bir kurye sertifikası verilir.
Madde X
Fonlar, Varlıklar ve Diğer Mülkler;
Olîs'in Resmi Araçları
1. Birleşmiş Milletler'in bağışıklığından açıkça feragat ettiği özel durumlar dışında, Ofis,
fonları, varlıkları ve diğer malları, nerede bulunursa bulunsun ve kimin elinde olursa
olsun, her türlü yasal süreçten bağışıklığa sahip olacaktır. Ancak bağışıklıktan feragat
edilmesinin, herhangi bir icra tedbirini kapsamayacağı kabul edilmektedir.
2.Hükümet, Ofisin resmi kullanımı için gerekli olan motorlu taşıtlara vergisiz akaryakıt
tahsisatı sağlayacaktır ve Ofisin talebi üzerine. Ofise ait resmi kullanım amaçlı araçlara
Ev Sahibi Ülkenin geçerli mevzuatına uygun olarak diplomatik plaka sağlanacaktır.
3. Ofisin malları, fonları ve varlıkları, her türlü kısıtlama, düzenleme, denetim ve
moratoryumdan muaf olacaktır.
4. Ofis, herhangi bir mali kontrol, düzenleme veya moratoryum ile sınırlandırılmaksızın,
faaliyetlerini yürütmek amacıyla:
(a) Her türlü fon, para birimi veya kıymetli evraka sahip olup bunları kullanabilir ve
herhangi bir para biriminde hesap bulundurup işletebilir ve sahip olduğu herhangi bir para
birimini başka bir para birimine dönüştürebilir; ve
(b) Fonlarını veya dövizlerini edinmekte, Ev Sahibi Ülkeden başka bir ülkeye veya Ev
Sahibi Ülke içinde Birleşmiş Milletler'e veya herhangi bir Birleşmiş Milletler ajansına
aktarmakta serbesttir.
Madde XI
Vergi, Harç, İthalat veya İhraeat Kısıtlamalarından Muafiyet
Resmi faaliyetleri ile ilgili olarak, Ofis, varlıkları, malları, gelirleri, faaliyetleri ve
İşlemleri aşağıdaki kolaylıklardan faydalanır:
(a) Gelir vergisi, kurumlar vergisi, motorlu taşıtlai' vergisi
bunlarla sınırlı olmamak kaydıyla tüm doğrudan vergil "

tüketim vergisi (sadece özel tüketim vergisi mükelleflerinden Ofis tarafından mal
alımlarıyla ilgili), katma değer vergisi ve özel iletişim vergisi dahil ancak bunlarla sınırlı
olmamak üzere dolaylı vergilerden muafiyet. Bununla birlikte, Ofis, esasen kamu hizmeti
ücretlerine tekabül eden oranlardan, vergilerden veya ücretlerden muafiyet talep
etmeyecektir.
(b) Ofisin resmi kullanımı için ithal veya ihraç ettiği mallara ilişkin vergi ve gümrük
vergileri ile ithalat ve ihracat yasak ve kısıtlamalardan muafiyet. Bununla birlikte, bu
muafiyet kapsamında ithal edilen malların ithal edildikleri Ev Sahibi Ülkede, Ev Sahibi
Ülke Hükümetiyle mutabık kalınan koşullar dışında satılmayacağı kabul edilmektedir.
(c) Ofis tarafından resmi faaliyetleri çerçevesinde ithal ya da ihraç edilen, yayımlanan
yayın, hareketsiz ve hareketli görüntü, fılrn, kaset, disket, kompakt disk ve benzer
nitelikteki diğer medya kayıtlarının ihı-acat veya ithalatında uygulanan vergiler ve gümrük
vergileri de dahil olmak üzere her türlü sınırlama ve kısıtlamadan muafiyet.
Madde XII
Resmi Görevliler
1. Resmi Görevliler, Ev Sahibi Ülkede aşağıdaki ayrıcalık, bağışıklık ve kolaylıklardan
yararlanacaktır:
(a) Resmi görevleri çerçevesinde yazılı veya sözlü beyanları ile gerçekleştirdikleri tüm
eylemlerle ilgili hukuki süreçlerden bağışıklık. Söz konusu bağışıklık, UNRWA ile iş
ilişkisi sona erdikten sonra geçerli olmaya devam edecektir.
(b) Suçüstü hali dışında görevlerini yerine getirirken gerçekleştirdikleri eylemlere ilişkin
olarak tutuklama ve gözaltına alınma ile kişisel ve resmi eşyaları ve bagajlarına el
koyulmasından bağışıklık. Suçüstü halinden kaynaklanan durumlarda Yetkili Makamlar,
UNRWA Ofis Başkanını tutuklama, gözaltına alma ya da el koymadan derhal haberdar
edecektir.
(c) UNRV/A tarafından Resmi Görevlilere ödenen maaş ve ikramiyelere ilişkin
vergilerden muafiyet; kendileri ve bakmakla yükümlü oldukları kişilerin Ev Sahibi Ülke
dışındaki kaynaklardan elde edilen gelirlerinin veya Ev Sahibi Ülke dışında bulunan
mülklerinin vergilerden muafiyeti.
(d) Ev Sahibi Ülkede zorunlu askerlik hizmetinden veya diğer herhangi bir zorunlu
hizmetten muafiyet.
(e) Kendileri ve balcmakla yükümlü oldukları kişilerin göç sınırlamaları ya da yabancı
kayıt prosedürlerinden muafiyeti.
(f) UNRWA Ofis Başkanı ve Yetkili Makamlaım üzerinde mutabık kaldığı
düzenlemelere uygun olarak kendileri için Ev Sahibi' Ülke içerisinde resmi iş amaçlı
dolaşım ve se)^ahat kısıtlamalarından muafiyet ve benzer şekildejcendjişri .ye bakmakla^^^^,^^

(g) Yerel para veya döviz hesaplarına ilişkin olarak en az Ev Sahibi Ülkedeki akredite
diplomatik misyon üyelerine tanınan kolaylıklardan eşit düzeyde yararlanma.
(h) Kendileri ve bakmakla yükümlü oldukları kişiler için uluslararası kriz zamanlarında
diplomatik temsilcilere sağlanan koruma ye tahliye imkanlarından yararlanma.
(i) Ev Sahibi Ülkenin vatandaşı olmamak veya söz konusu ülkede daimi ikamet iznine
sahip olmamak kaydıyla, kişisel kullanım amacıyla gümrük vergileri ve tüm vergiler
(katma değer ve özel tüketim vergisi dahil) ile ithalat yasakları ve kısıtlamalarından muaf
olarak aşağıdakileri ithal etme hakkı:
i. Ev Sahibi Ülkeye yerleştikten sonraki altı ay içerisinde mobilyalar, ev eşyaları
ve kişisel eşyalar. Söz'konusu malzeme, gümrük vergisi ya da gerekli diğer vergiler
ödenmedikçe yerel piyasada satışa çıkarılamayacaktır. Ev Sahibi.Ülke Hükümeti, ilgili
Resmi Görevli tarafından belgelendirilmesi ve Ofis tarafından desteklenmesi durumunda
altı aylık sürenin uzatılması veya söz konusu süreden muafiyete yönelik talebi özenle
değerlendirecektir;
ii. Hükümetin mevcut düzenlemelerine uygun olarak tek seferde bir motorlu taşıt.
Bu hüküm gereğince ithal edilen motorlu taşıtlar, ithal edildikten sonra Ev Sahibi Ülkenin
ilgili mevzuatına tabi olarak Ev Sahibi Ülkede satılabilir;
İÜ. Hükümetin mevcut düzenlemelerine uygun olarak hediye veya satış amacıyla
olmamak kaydıyla, kişisel kullanım ya da tüketime yönelik alkollü içki, tütün ve gıda
maddesi dahil makul miktardaki belirli ürünler;
(j) Türk vatandaşı veya Türkiye'de daimi ikamet iznine sahip olmamak kaydıyla, katma
değer vergisi, özel tüketim vergisi, yerel piyasadan motorlu taşıt satın alırken uygulanan
diğer vergiler ve motorlu taşıtlar vergisinden muafiyet. Söz konusu taşıtlar, gerekli
vergiler ödenmedikçe yerel piyasada satılamayacaktır.
(k) Türkiye'deki görevlerini tamamladıklarında, motorlu taşıtlar da dahil olmak üzere
mobilya, ev eşyası ve kişisel eşyaları vergi ve harç ödemeksizin ihraç etme hakkı.
(I) Kendileri ve bakmakla yükümlü oldukları kişiler için Ev Sahibi Ülkede gerekli görülen
eğitim ve mesleki niteliklerin edinilmesine yönelik lisans ve lisansüstü derecelerinin ve
ilgili eğitimlerin alınması için Ev Sahibi Ülke vatandaşlarına sağlanan koşullardan daha
alelverişli olmayacak şekilde, üniversitelere ve diğer yüksek öğrenim kurumlarına, söz
konusu kurumların giriş koşullarına uygun olarak girme hakkı.
(m) Kendileri ve bakmakla yükümlü oldukları kişiler için Ev Sahibi Ülkedeki
havaalanlarmda'pasaport kontrolü dâhil seyahat esnasında diplomatik kanalları kullanma
hakkı.
2. Türk vatandaşı ya da Ev Sahibi Ülkede daimi ikamet izni olan Resmi Görevliler, Ev
Sahibi Ülke tarafından Genel Sözleşme'ye getirilen çekincelere tabi olarak sadece Genel
Sözleşme'nin 18. Bölümünde belirtilen ayrıcalık ve bağışıkhkj^rtop'ar^lanacaklardır.

. Madde XÎII
Ofis Başkanı
1. XII. Maddede belirtilen hükümlere halel getirmemek kaydıyla, Ev Sahibi Ülkenin
vatandaşı veya söz konusu ülkede daimi- ikamet iznine sahip olmamak şartıyla, Ofîs
Başkanı ve Ofis Başkam tarafından atanabilen yardımcısı, Ev Sahibi Ülkede ikamet
ettikleri süre zarfında, Genel Sözleşme'nin 19. Bölümü uyarınca diplomatik temsilcilere

2. Yukarıdaki XIIL Maddenin 1. paragrafında değinilen ayrıcalık, bağışıklık ve
kolaylıklar, söz konusu Görevlilerin bakmakla yükümlü oldukları kişilere de tanınacaktır.
Madde XIV
Görevli Uzmanlar
1. Genel Sözleşmenin VI. ve VII. Maddelerinde belirtilen ayrıcalık, bağışıklık ve
kolaylıklar Ofisteki Görevli Uzmanlara da tanınacaktır.
2. Görevli Uzmanlar, Ofis tarafından kendilerine ödenen maaş ve diğer ücretlerin
vergilendirilmesinden muaf olacaktır ve Taraflar arasında mutabık kalınan tamamlayıcı
bir anlaşma ile ek ayrıcalık, bağışıklık ve kolaylıklardan yararlandırılabileceklerdir.
3. Türk vatandaşı olan veya Ev Sahibi Ülkede daimi ikamet statüsü bulunan Görevli
Uzmanlar, sadece Genel Sözleşme'nin VI. ve VII. Maddeleri kapsamına giren ayrıcalık
ve bağışıklıklardan yararlanacaktır.
Madde XV
Bağışıklıktan Feragat
Bu Anlaşmada atıfta bulunulan ayrıcalık, bağışıklık ve kolaylıklar ilgili şahıslara kişisel
yararlan için değil, UNRWA'nın menfaati için sağlanmaktadır. Genel Sekreter,
bağışıklığın adaletin tecellisini engelleyeceğine ve Birleşmiş Milletler'in menfaatine
halel getirmeksizin kaldırılabileceğine kanaat getirdiği her durumda, bu şahıslann
bağışıklığından feragat etme hakkı ve sorumluluğuna sahip olacaktır.
Madde XVI
Ev Sahibi Ülkeye Giriş, Çılaş, Ev Sahibi Ülkede Seyahat ve Konaklama
1. Ev Sahibi Ülke Hükümeti, bu Anlaşmanın XII ila XIV. Maddelerinde bahsedilen tüm
şahısların Ev Sahibi Ülkeye engelsiz giriş ve çıkışları ile Ev Sahibi Ülke içerisinde
konaklama-ve serbest dolaşımlarım-kolaylaştırmak ve sağJîtfŞapiŞir^ gerekli
öıilemleri alacaktır.

2. Hükümet,Ofis için veya Ofisle bağlantılı resmi görev, iş ve faaliyetlerde bulunan diğer
tüm şalusların Ev Sahibi Ülkeye giriş ve çıkışları ile Ev Sahibi Ülkede konaklama ve
serbest dolaşımlarım kolaylaştırmak için elinden geleni yapacaktır.
3.Yetkili Makamlar, Ev Sahibi Ülkenin kanun ve düzenlemeleri uyarınca, Ofise atanan
Resmi Görevlilerin hane halkı çalışanlarına, gerektiğinde, vize, ikamet izni ve diğer
belgeleri düzenleyecektir.
Madde XVII
Birleşmiş Milletler Lesepasesi, Sertifikalar ve Vizeler
1.Hükümet, Resmi Görevlilere verilen Birleşmiş Milletler Lesepasesini geçerli bir
seyahat belgesi olarak tanıyacak ve kabul edecektir,
2.Genel Sözleşmenin YIL Maddesi, 26. Bölümü hükümleri uyarınca, Yetkili Makamlar,
Birleşmiş Milletler işleri için seyahat eden uzmanlara ve diğer şahıslara verilen Birleşmiş
Milletler sertifikasını tanıyacak ve kabul edecektir.
3. Bu Anlaşmada atıfta bulunulan tüm şahıslara hızlı seyahat için kolaylık sağlanacaktır.
Vizeler, giriş izinleri veya ruhsatlar ve gerekli durumlarda ikamet izinleri, bu Anlaşmada
belirtilen şahıslara, onların bakmakla yükümlü oldukları kişilere ve Ofisin resmi
çalışm^alan ve faaliyetleri ile bağlantılı olarak Ofise davet edilen diğer şahıslara ücretsiz
olaıak ve mümkün olan en kısa sürede verilecektir.
4. Ev Sahibi Ülke Hükümeti, diğer Birleşmiş Milletler seyahat sertifikası sahiplerine
gerekli vizelerin verilmesini kolaylaştırmayı da kabul eder.
Madde XVIII
Kimlik Kartı
1.Ev Sahibi Ülke, kural" ve yönetmeliklerine uygun olarak, tüm Ofis personeline ve
bakmakla yükümlü oldukları kişilere uygun kimlik kartı düzenleyecektir.
2. Ofiste geçici- olarak görevlendirilen diğer şahıslara. Ev Sahibi Ülkenin kural ve
yönetmeliklerine göre geçici görevlendinne belgesi verilebilir.
3. Yetkili Makamlann yetkili bir görevlisinin talebi üzerine, yukarıdaki XVII]. maddenin
1. ve 2. paragraflarında'atıfta bulunulan şahıslaım kimlik kartlarını ibraz etmeleri
gerekecektir.

Bayraklar, Amblem ve İşaretler
Ofis, Ofis binalarında ve resmi amaçlarla kullanılan

Sosyal Güvenlik
1.Taraflar, UNRWA ve uyruklarına bakılmaksızın Resmi Görevlilerinin, söz konusu
Görevlilerin kapsamlı bir sosyal güvenlik programı sunan UNRWA Personel
Düzenlemeleri ve Kurallarına tabi olmaları nedeniyle, UNRWA'daki görevleri sırasında
Türkiye'nin zaruri sigorta ve sosyal güvenlik programlarına yönelik zorunlu katkı
uygulamalarına ilişkin Ev Sahibi Ülke kanunlarından muaf olacağını kabul eder.
2.Yukarıdaki XX. Maddenin 1. Paragrafında kayıtlı hükümleri, Ev Sahibi Ülkede
istihdam edilmedikleri veya kendi nam ve lıesaplarma çalışmadıkları yahut Ev Sahibi
Ülkeden sosyal güvenlik yardımları almadıkları sürece, bakmakla yükümlü oldukları
kişilere de mutatis mutandis uygulanacaktır.
Madde XXI
Bakmakla Yükümlü Olunan Kişiler için Çalışma İzinleri
Yetkili Makamlar, Ev Sahibi Ülkedeki Ofise atanan Resmi Görevlilerin bakmakla
yükümlü oldukları kişilere çalışma izni verecektir. Bu tür izinlerin verilmesi hususunda
Ev Sahibi Ülkenin mevzuatı geçerli olacaktır. Resmi Görevlilerin bakmakla yükümlü
olduğu kişiler UNRWA veya Birleşmiş Milletler teşkilatı içerisinde yer alan herhangi bir
örgüt dışında kazanç getirici bir işle meşgul oldukları takdirde, ayrıcalık ve bağışıklıklar
söz konusu işe ilişkin olarak uygulanmayacaktır. UNRWA veya Birleşmiş Milletler
teşkilatı içerisinde yer alan herhangi bir örgüt içinde kazanç getirici bir işle meşgul
olunması durumunda ise ilgili Ev Sahibi Ülke Anlaşmasında belirtilen ayrıcalık ve
bağışıklıklar uygun şekilde tatbik edilecektir.
Madde XXII
Yetkili Makamlarla İşbirliği
1. Bu Anlaşma ile tanınan ayrıcalık ve bağışıklıklara halel getimıemek kaydıyla, söz
konusu ayrıcalıklar, bağışıklık ve kolaylıklardan yararlanan tüm şalnslar Ev Sahibi
Ülkenin kanun ve düzenlemelerine ujma ve içişlerine karışmama yükümlülüğü
altındadır.
2.Bu Anlaşmada belirtilen ayrıcalık, bağışıklık ve kolaylıklara halel getimıemek
kaydıyla. Ofis, adaletin tecellisini kolaylaştırmak, emniyet m.evzuatına uyulmasını
sağlamak ve işbu Anlaşmada belirtilen şahıslara tanınan kolaylık, ayrıcalık ve
bağışıklıklarla bağlantılı olarak herhangi bir suistimalin ortaya çıkmasını önlemek için
Yetkili Makamlarla her daim işbirliği içerisinde olacaktır.

Madde XXIII
Tamamlayıcı Düzenlemeler
Taraflar, uygun gördükleri takdirde, tamamlayıcı anlaşmalar imzalayabilirler. Tarafların
üzerinde anlaşacağı tamamlayıcı anlaşmalar, aşağıdaki XXV. Maddenin, 4. Paragrafında
öngörülen aynı yasal prosedüre uygun olarak yürürlüğe girecektir.
Madde XXIV
Uyuşmazlıkların Çözümü
1.UNRWA, aşağıdakilere yönelik uygün çözüm yöntemleri için gerekli önlemleri
alacaktır:
(a) Sözleşmelerden doğan uyuşmazlıklar veya UNRWA'nın taraf olduğu diğer özel
hukuk uyuşmazlıkları; ve,
(b) Genel Sekreter tarafından bağışıklıktan feragat edilmediği takdirde, resmi konumu
nedeniyle bağışıklıktan yararlanan herhangi bir Ofis Resmi Görevlisinin dahil olduğu
uyuşmazlıklar.
2. Taraflar arasında nlüzakereyle veya üzerinde mutabık kalınan başka bir yolla
çözülemeyen bu Anlaşmadan doğan veya bu Anlaşmayla ilgili herhangi bir uyuşmazlık,
Taraflardan birinin talebi üzerine, üç Hakemli bir Kurula sunulacaktır. Taraflardan hef
biri bir hakem tayin edecek ve tayin edilen bu iki hakem Kurulun başkanı olacak üçüncü
hakemi tayın edecektir. Tahkim talebinden itibaren otuz gün içerisinde, Taraflardan biri
hakem tayin etmediği takdirde veya iki'hakemin tayin edilmesinden sonraki on beş gün
içerisinde üçüncü hakem tayin edilmezse, Taraflardan biri Uluslararası Adalet Divanı
Başkanından bahsekonu' hakemi belirlemesini talep edebilir. Hakemlerden herhangi
ikisinin her "türlü amaç için yeter sayıyı oluşturduğu ve her türlü karar için herhangi iki
hakemin mutabakatının gerektiği yönündeki hükümler saklı kalmak kaydıyla Kurul kendi
usullerini belirleyecektir. Yargılama giderleri, Tahkim Kurulu tarafından yapılan
değerlendirme çerçevesinde Taraflaı-ca karşılanacaktır. Tahkim kararı, dayandığı
gerekçeye ilişkin bir açıklama içerecek ve Taraflar için nihai ve bağlayıcı olacaktır.
Madde XXV
Son Hükümler
1. İşbu Anlaşma, Tarafların yazılı mutabakalıyla değiştirilebilir. Taraflarca karşılıklı
olarak üzerinde mutabık kalınan herhangi bir değişiklik, işbu XXV. Maddenin 4.
paragrafında öngörülen yasal prosedüre uygun olarak yürürlüğe girecektir.
2. İşbu Anlaşma, Taraflardan birinin diğerine diplomatik kanallar aracılığıyla yazılı
bildirimde bulunmasıyla feshedilebilir ve söz konusu bildirimin alınmasından altı ay
sonra sona erer. İşbu Anlaşma, bu tür bir fesih bildiriminden bş_giînESiZî.^arak, Anlaşma
ile üstlenilen tüm yükümlülüklerin tamamen yerine getirilme^yeyâ:^n^^efmesine kadar;
geçerli kalacaktır.

3. Hükümet tarafından üstlenilen yükümlülükler, İşbu Anlaşmanın feshinden sonra,
Ofisin ve işbu Anlaşmaya binaen atanan Resmi Görevlilerin malları, fonları ve
varhklannın düzenli biçimde geri çekilmesi için gerekli olabilecek süre boyunca
geçerliliğini koruyacaktır.
4. İşbu Anlaşma her iki Tarafça imzalanacaktır. İşbu Anlaşma, Ev Saliibi Ülke
Hükümeti'nin, Anlaşmanın yürürlüğe girmesi için gerekli iç hukuk onay sürecini
tamamladığını UNRWA'ya bildirdiği günü takip eden ayın ilk günü yürürlüğe girecektir.
YUKARIDAKİ HUSUSLAR MUVACEHESİNDE, işbu Anlaşma, aşağıda imzası
bulunan. Tarafların usulüne uygun olarak atanan temsilcileri tarafından, İstanbul'da 21
Haziran 2025 tarihinde İngilizce dilinde, her ikisi de eşit derecede geçerli olmak üzere iki
asıl nüsha olarak imzalanmıştır.
Türkiye Cumhuriyeti, işbu Anlaşma'nın Türkçeye resmi tercümesini temin edecektir.

AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF
TÜRKİYE AND THE UNITED NATIONS RELIEF AND WORKS AGENCY FOR
MLESTINE REFÜGEESIN THE NEAR EAST CONCERMING THE
ESTABLISHMENT OF THE UNRWA OFFICE ESf ANKARA
WHEREAS the United Nations Relief and Works Agency for Palestine Reflıgees in the Near
East (UNRWA) was established by the United Nations General Assembly Resolution 302
(TV) of 8th December 1949 as subsidiary organ of the United Nations, to provide relief and
works programs in support of Palestine reflıgees,
CONSIDERING that the Convention on thePrivileges and Immunities of the United Nations
was adopted by the General Assembly ofthe United Nations on 13 February 1946, to which
Türkiye acceded on 2 August 1950 with certain reservations;
WHEREAS the Republic of Türkiye and UNRWA have held consultations with a view to
establish in Ankara, an offıce for the purpose of undertaking activities in support of the
mandate conferred on UNRWA by the United Nations General Assembly;
NOW, THEREFORE the Republic of Türkiye and UNRWA, represented by the Government
of the Republic of Türkiye (the "Government") and UNRWA, hereinafter collectively
referred to as "the Parties" and each as a "Party", have agreed as follows:
ArticieI
Defînîtions
1. For the purposes of this Agreement,
(a) "Host Country" means Türkiye;
(b) "Offıce" means the UNRWA offıce to be established in Ankara with the written consent
of the Host Country;
(c) "Head of the Cffıce" means the UNRWA offıcial who is in charge of the Offıce;
(d) "Offıcials" means ali UNRWA staff members assigned to service the Offıce, irrespective
of nationality, with the exception of those who are locally recruited and paid hourly rates, as
provided for in United Nations General Assembly resolution 76(1) of 7 December 1946;
(e) "Experts on Mission" means persons, other than offıcials, performing missions and
activities at the request of, or on behalf of, the Offıce;
(f) "Dependents" refers to;

i) a spouse, to be communicated to the recetving State by the respective diplomatic
mission or consular post and approved by such State in accordance with its national
legislation.
ii) Unmarried children under 21 years of age;
İÜ) Unmarried children under 25 years, enrolled in a university or higher education
center recognized by the Host Country.
(g) "General Convention" means the Convention on the Privileges and Immunities of the
United Nations adopted by the General Assembly on 13 February 1946, to which the Host
Country is a party;
(h) "Competent Authorities" means the Ministry of Foreign Affairs of the Host Country;
(i) "Premises of the Offıce" means the building or part of building occupied permanently or
temporarily by the Offıce with the written consent of the Host Government;
0 "Archives of the Offıce" means ali records, correspondence, documents, manuscripts,
computer records, stili and motion pictures, film and sound recordings, belonging to or held
by the Offıce in performance of its functions;
(k) "Property of the Offıce" means ali property, inciuding funds, income and other assets
belonging to the Offıce or held or administered by the Offıce in flırtherance of the flınctions
of the Offıce;
(1) "Secretary-General" means the Secretary-General of the United Nations;
ArticleII
Establishment and Location of the Office
1. The seat of the Offıce shall be established in Ankara, Türkiye, to carry out functions in
support of UNRWA's mandate pursuant to the United Nations General Assembly resolution
302 (IV) of 8 December 1949.
2. In accordance "with the provisions of Section 17 of the General Convention, the
Competent Authorities shall be periodically informed of the names of the Offıcials assigned
to the Offıce.
ArticleIII
Juridical Personality
l.The Offıce shall possess juridical personality in the Host Country. It shall have the
capacity:
(a) to contract;
(b) to acquire and dispose of immovable and movable property;
(c) to institute legal proceedings.

2. For the purposes of this Agreement, the Offıce shall be represented by the Head of the

Article IV
Purpose and Scope of the Agreement
1.This Agreement regulates the status of the Premises of the OfHce, Offıcials and Experts
on Mission in the Host Country.
2. This Agreement sets out the arrangements necessary for the effective discharge of the
functions of the Offıce.
Article V
Application of the General Convention
The General Convention shall be applicable to the Offıce, its property, funds and assets, and
to its Offıcials and Experts on Mission in the Host Country without prejudice to the
reservations made by the Host Country to the General Convention.
Article VI
Invioiability of the Ofiice
1. The Premises of the Offıce shall be inviolable and its property, funds and assets, wherever
located and by whomsoever held, shall be immune in accordance with Section II and Section
III of the General Convention.
2. No offıcer or offıcial of the Host Country or person exercising any public authority v/ithin
the Host Country, shall enter the premises of the Offıce to perform any duties therein except
with the consent of, and under the conditions approved by, the Head of the UNRWA Offıce.
3. In case of a fire or other emergency requiring prompt protection action, the consent of
the Head of the UNRWA Offıce to any necessary entry into the premises shall be presumed
if he or she cannot be reached in time.
4. The Premises of the Offıce shall not be used in any manner incompatible with the purpose
and scope of the Offıce, as set forth in Articles II and IV above. The Head of the Offıce may
also permit, in a manner compatible with the functions of the Offıce, the use of the Premises
of the Offıce and its facilities for meetings, seminars, exhibitions and similar activities which
are organized by the Offıce, the United Nations or other related organizations.
5. The Archives of the Offıce, and in general ali documents and materials made available,
belonging to or used by it, wherever located in the Host Country, shall be inviolable.

Article VII
Security and Protection
1. The Competent Authorİties shall ensure the security and protection öf the Pfemises of the
Offıce and exercise due diligence to ensure that the tranquility of the Premises of the Offıce
is not disturbed by the unauthorized entry of persons or groups of persons from outside or
by disturbances in its immediate vicinity. If so requested by the Head of the OffIce, the
Competent Authorİties shall provide necessary protection and assistance forthe preservation
of law and order in the Premises of the Offıce or in its immediate vicinity, and for the
removal of persons therefrom.
2. The Competent Authorİties, upon request of the Offıce, shall take effective and adequate
action which may be required to ensure the appropriate security, safety and protection of
persons referred to in this Agreement, in the discharge of their offıcial functions or work for
the Offıce, indispensable for the proper functioning of the Offıce free from interference of
any kind.
Article Vm
Public Services
1. The Competent Authorİties shall facilitate, upon request of the Head of the Offıce and
under terms and conditions not less favourable than those accorded by the Govemment to
any accredited diplomatic mission, access to the public services needed by the Offıce such
as, but not limited to, utility, power and communications services.
2. In cases where public services referred to in Article VIU, paragraph 1 above, are made
available to the Offıce by the Competent Authorİties or where the prices thereof are under
their control, the rate for such services shall not exceed the lowest comparable rates accorded
to accredited diplomatic missions.
3. In case of force majeure, resulting in a complete or partial disruption of the abovementioned services, the Offıce shall, for the performance of its functions, be accorded not
less favourable than that accorded by the Host Country to any diplomatic missions.
4. The provisions of this Article VUI shall not prevent the application of measures of the
Host Country for fire protection or sanitary regulations.
Article IX
Communications Facilities
I xhe Govemment shall secure the inviolability of the ofîicial communications of the
Offıce, vvhatever the means of the communications employed, and shall not apply any
censorship to such communications.
2. The Offıce shall enjoy, for its offıcial communications, treatment not less favourable than
that accorded by the Host Country to any accredited

priorities, rates and taxes on mails, cables, telegrams, telex, telephotos, telephone and other
communication and press rates for informaticn to the press and radio.
3. The Offıce shall have the right to operate software and other programmes,
communications equipment, inciuding telecommunications (meaning any emission,
transmission, or reception of written or verbal informaticn, images, sound or information of
any nature by wire, radio, satellite, optical, fıbre or any other electronic or electromagnetic
means) and to use codes and to dispatch and receive correspondence by couriers and bags,
which shall have the same immunities and privileges as diplomatic couriers and bags. The
bags must bear visibly the UNRWA emblem and may contain oniy documents or articles
intended for offıcial use, and the courier shall be provided with a courier certifıcate issued
by theUMlWA.
Article X
Funds, Assets and Other Property;
Official vehicles of the Offıce
1. The Offıce, its funds, assets and other property, wherever located and by whomsoever
held, shall enjoy immunity from every form of legal process except in so far as in any
particular case the United Nations has expressly waived its immunity. It is understood,
however, that no waiver of immunity shall extend to any measure of execution.
2. The Govemment shall grant allotments of fuel tax free for motor vehicles required for the
offıcial use of the OfTıce, and, upon request of the Offıce, diplomatic plates will be provided
for vehicles owned by the Offıce for offıcial use, in accordance with the applicable
regulations of the Host Country.
3. The property, funds and assets of the Offıce shall be exempt from restrictions, regulations,
controls and moratoria of any nature.
4. Without being restricted by fınancial controls, regulations or moratoria of any kind, the
Offıce, in orderto carry out its activities:
(a) May hold and use funds, currency or negotiable instruments of any kind and maintain
and operate accounts in any currency and convert any currency held by it into any other
currency; and
(b) Shall be free to receive and transfer its funds or currency from the Host Country toanother
country, or within the Host Country, to the United Nations or any United Nations agency.
Article XI
Exemption from Taxes, Duties, Import or Export Restrictions
With respect to its offıcial activities, the Offıce, its assets, property, income, its operations
and transactions shall enjoy:

(a)Exemption from ali direct taxes inciuding but not limited to income tax, corporate inceme
tax, motor vehicles tax and property tax, as well as indirect taxes, inciuding but not limited
to fee, stamp duty, special consumption tax (only related to purchases ofgoods by the Offıce
ffom special consumption tax taxpayers), value added tax, and special communication tax.
However, the Offıce will not daim exemption from rates, taxes or fees which are in fact no
more than charges fer public utility services.
(b) Exemption from taxes and customs duties and prohibitions and restrictions on imports
and exports in respect of articles imported or exported by the Offıce for its offıcial use. It is
understood, however, that articles imported under such exemption Wû\ not be sold in the
Host Country into which they were imported except under conditions agreed with the
Government of the Host Country.
(c) Exemption ffom ali limitations and restrictions, inciuding taxes and customs duties, on
the import or export of publications, stili and moving pictures, fılms, tapes, diskettes,
Gompact disks and other similar media recordings imported, exported or published by the
Offıce within the framework of its offıcial activities.
Article Xn
Officials
1. Officials shall enjoy the following privileges, immunities and facilities in the Host
Country:
(a) Immunity from legal process in respect of words spoken or written and ali acts
performed by them in their offıcial capacity. Such immunity shall continue in force after
termination of employment with UNRWA.
(b) Immunity from personal arrest or detention and from seizure of their personal and offıcial
effects and baggage for acts performed in the discharge of their functions except in case of
flagi'anie deîicto, and in such cases the Competent Authorities shall immediately inform the
Head of the UlSfRWA Offıce of the arrest, detention or seizure.
(c) Exemption from taxation of officials on the salaries and emoluments paid to them by
UNRWA; exemption from taxation on ali income and property, for themselves and for their
dependents in so far as such income derives from sources, or insofar as such property is
located outside the Host Country.
(d) Exemption from any military service obligations or any other obligatory service in the
Host Country.
(e) Exemption, for themselves, their dependents, from immigration restrictions or alien
registration procedures.

for their dependents for recreation in accordance with arrangements agreed upon between
the Head of the UNRWA Offıce and the Competent Authorities.
(g) In regard to accounts held in either local or foreign currencies, enjoyment of facilities at
least equal to those accorded to members of diplomatic missions accredited to the Host
Country.
(h) The same protection and repatriation facilities with respect to themselves and dependents
as are accorded in time of international crisis to diplomatic envoys.
(i) The right to import for their personal use, free of customs duties and alİ taxes (inciuding
value added and special consumption tax), prohibitions and restrictions on imports on the
condition that they are not nationals of or permanent residents in the Host Country:
i. Within six months of taking up residence in the Host Country, their fijrniture,
household and personal effects. Such material shall not be put on sale in the domestic market
without paying customs duty or any other applicable tax. The Government of the Host
Country shall give due consideration to any request for extension or waiver of the six-month
period that is substantiated by the Offıcial concerned and supported by the Offıce;
ii. In accordance with existing Government regulations, one motor vehicle at atime.
Motor vehicles imported in accordance with this provision may be sold in the Host Country
after their importation, subject to the applicable regulations of the Host
Country;
İÜ. Reasonable quantities of certain articles inciuding liquor, tobacco and foodstuff,
for personal use or consumption and not for gift or sale, in accordance ■with existing
Government regulations;
(j) Exemption from value added tax, special consumption tax, and other related taxes on the
domestic purchase of one motor vehicle, and motor vehicle tax, on the condition that they
are not nationals of or permanent residents in Türkiye. Such vehicles shall not be sold in the
domestic market v/ithout paying any applicable tax.
(k) The right, on completion of their functions in Türkiye, to export their furniture, house
ware and personal effects, inciuding motor vehicles, without duties and taxes.
(I) For themselves and their dependents on terms not less favourable than citizens of the Host
Country, the right of access to universities and other institutİons of higher education, in
accordance with the applicable entry requirements for such institutİons, for the purpose of
obtaining graduate and post-graduate degrees and related training leading to the attainment
of the relevant educational and professional qualifıcations required in the Host Country.
(m) For themselves and their dependents, the right to use diplomatic channels at the time of
travel, inciuding passport check, at airports in the Host Country.

2. Offıcials of Turkish nationality or permanent residents of the Host Country shall enjoy
only those privileges and immunities provided for in Section 18 of the General Convention,
subject to reservations established by the Host Country to the General Convention.
Article Xin
Head of the Ofîice
1. Without prejudice to the provisions of Article Xn, the Head of the Offıce and his/her
deputy who may be designated as such by the Head of the Offıce, shall enjoy during their
residence in the Host Country the privileges, immunities and facilities granted to diplomatic
envoys in accordance with Section 19 of the General Convention provided they are not
nationals or permanent residents of the Host Country. Their names shall be inciuded in the
diplomatic üst.
2. The privileges, immunities and facilities referred to in Article XIII, paragraph 1 above
shall also be accordedto the dependents of the Ofîîcials concerned.
Article XIV
Experts on Mission
1. Experts on Mission for the Offıce shall be granted the privileges, immunities and facilities
specified in Articles VI and VII of the General Convention.
2. Experts on Mission shall be granted exemption ffom taxation on the salaries and other
emoluments paid to them by the Offıce, and may be accorded such additional privileges,
immunities and facilities as may be agreed upon between the Parties through a
supplementary agreement.
3. Experts on Mission of Turkish nationality or with permanent residency status in the Host
Country shall enjoy only those privileges and immunities that come within the scope of
Articles VI and VII of the General Convention.
Article XV
"VVaiver oflmmunity
The privileges, immunities and facilities referred to in this Agreement are granted to the
relevant persons in the interest of UNRW A and not for their personal benefıt. The Secretary-
General shall have the right and the duty to waive immunity of these persons, in any case
where, in the Secretary-General's opinion, the immunity would impede the course of justice
and can be waived without prejudice to the interests of the United Nations.

Article XVI
Entry into, exit from, movement aııd stay within the Host Country
1. The Government of the Host Country shall taka ali necessary measures to facilitate and
ensure the unimpeded entry into, exit from, stay and free movement within the Host Country
for ali persons referred to in Articles XII through XIV of this Agreement.
2. The Government shall do its utmost to facilitate the entry into and exit from, stay and free
movement within the Host Country for ali other persons performing offıcial functions, work
and activities for, or in connection with, the Offıce.
3. The Competent Authorities, in accordance with the rules and regulations of the Host
Country, shall issue visas and residence permits and any other documents, where required,
to household employees of Offıcials assigned to the Offıce.
Article XVn
United Nations Laissez-Passer, Certificates and Visas
1. The Government shall recognize and accept the United Nations laissez-passer issued to
Offıcials as a valid travel document.
2. In accordance with the provisions of Article VII, Section 26 of the General Convention,
the Competent Authorities shall recognize and accept the United Nations certifıcate issued
to experts and other persons travelling on the business of the United Nations.
3. Ali persons referred to in this Agreement shall be granted facilities for speedy travel.
Visas, entry permits or licenses, where required, and residence permits shall be granted free
of charge and as promptly as possible to the persons referred to in this Agreement, their
dependents and other persons invited to the Ofîîce in connection with the offıcial work and
activities of the Offıce.
4. The Government of the Host Country flırther agrees to facilitate the issuance of any
required visas to the holders of other United Nations travel certificates.
Article XVm
Identification
1. The Host Country shall issue, in accordance with its rules and regulations, appropriate
identifıcation cards to all members of the personnel of the Offıce and their dependents.
2. Any other persons temporarily assigned to the Offıce may be granted a temporary
assignment note according to the rules and regulations of the Host Country.

3. Upon the demand of an authorized ofFıcial of the Competent Authorities, personsreferred
to in Article XVîn, paragraphs 1 and 2 above shall be required to present their identifıcation
cards.
Article XIX
Flags, Emblenı and Markings
The Offıce shall be entitled to display the IJNRWA flag, logo, emblem and markings in the
Premises of the Offıce and on vehicles used for offıcial purposes.
Article XX
Social Security
1. The Parties agree that, because Offıcials are subject to the UNRWA StaffRegulations and
Rules, which establish a comprehensive social security scheme, UNRWA and its Offıcials,
irrespective of nationality, shall be exempt from the laws of the Host Country on mandatory
coverage and compulsory contributions to the social security schemes of Türkiye during
their appointment with IJNRWA.
2. The provisions of Article XX, paragraph 1 above shall apply nnıîatis mutandis to
dependents, unless they are employed or self-employed in the Host Country or receive social
security benefıts from the Host Country.
Article XXI
Working permits for dependents
The Competent Authorities shall grant working permits for dependents of offıcials assigned
to the Offıce whose duty station is in the Host Country. The regulations of the Host Country
shall apply in connection to granting of such permits. Insofar as they engage in gainful
occupation, other than with UNRWA or any other related United Nations system
organization, privileges and immunities shall not apply with respect to such occupation. In
case of gainful occupation with IINRWA or any other related United Nations system
organization, privileges and immunities stated in the relevant Host Country Agreement shall
be applied as appropriate.
Article XXn
Cooperation with the Competent Authorities
1. Without prejudice to the privileges and immunities accorded by this Agreement, it is the
duty of ali persons enjoying such privileges, immunities and facilities to respect the laws and
regulations of the Host Country, and not to interfere in the internal affairs of the Host
Country,

2. Without prejudice to the privileges, immunities and facilities referred to in this
Agreement, the OfFıce shall cooperate at ali times with the Competent Authorities to
facilitate the proper administration of justice, secure the observance of poliçe regulations
and prevent the occurrence of any abuse in connection with the facilities, privileges and
immunities accorded to persons referred to in the present Agreement.
Article XXm
Supplemental Arrangements
The Parties may enter into any other supplemental agreements as the Parties may deem
appropriate. Any other supplemental agreements that the Parties may agree shall enter into
force in accordance with the same legal procedure prescribed under Article XXV, paragraph
4 below.
Article XXIV
Settlement of Disputes
1. UNRWA shall make provisions for appropriate modes of settlement for:
(a) disputes arising out of contracts or other disputes of a private law character to which
UNRWA is a party; and
(b) disputes involving any Official of the Offıce who by reason of his or her offıcial position
enjoys immunity, if such immunity has not been waived by the Secretary-General.
2. Any dispute between the Parties arising out of, or relating to this Agreement, which is
not settied by negotiation or another agreed mode of settlement, shall, at the request of either
Party, be submitted to aTribunal ofthree arbitrators. Each Party shall appoint one arbitrator,
and the two arbitrators so appointed shall appoint athird, who shall be the chairperson of the
Tribunal. If, within thirty days of the request for arbitration, a Party has not appointed an
arbitrator, or if, within fıfteen days of the appointment of twû arbitrators, the third arbitrator
has not been appointed, either Party may request the President of the Intemational Court of
Justice to appoint the arbitrator referred to. The Tribunal shall determine its own procedures,
provided that any two arbitrators shall constitute a quorum for ali purposes, and ali decisions
shall require the agreement of any two arbitrators. The expenses of the Tribunal shall be
borne by the Parties as assessed by the Tribunal. The arbitral award shall contain a statement
of the reasons on which it is based and shall be final and binding on the Parties.
Article XXV
Final Provisions
1. This Agreement may be modifıed by v/ritten agreement between the Parties hereto. Any
amendment mutually agreed upon by the Parties as such shall enter into force in accordance
with the same legal procedure prescribed under paragraph 4 of this Article XXV.

2. This Agreement may be terminated by either Party by written notice through diplomatic
channels to the other and shall terminate six months after receipt of sucb notice.
Notwithstanding any such notice of termination, this Agreement shali remain in force until
complete fulfilment or termination of ali obligations entered into by virtue of this
Agreement.
3. The obligations assumed by the Govemment shall survive the termination of this
Agreement, to the extent necessary to allow orderly withdrawal of the propeıty, funds and
assets of the Offıce and Offıcials assigned to it by virtue of this Agreement.
4. This Agreement shall be subject to the signature of both Parties. İt shall enter into force
on the fırst day of the month following the day the Govemment of the Host Counti'y has
notifıed UKRWA that the necessary internal legal procedures required for its entry into force
have been flılfılled.
İN W1TNESS WHEREOF, the undersigned, duly appointed representatives of the Parties,
have signed the present Agreement at İstanbul on this 2 İst day of June 2025 in the English
language in two originals, both equally authentic.
TheRepublic of Türkiye shall provide an offıcial translation of this Agreement into Turkish.
