Türkiye Cumhuriyeti Hükûmeti ile Moldova Cumhuriyeti Hükûmeti Arasında Meslekî Eğitim Alanında İş Birliği Protokolünün Notalarla Birlikte Onaylanmasının Uygun Bulunduğuna Dair Kanun Teklifi

Amaç İşbu Protokolün amacı, mesleld eğitim alanında iki Taraf arasında mutabık kalınan iş birliğini geliştirmek ve bu kapsamda, Türk İşbirliği ve Koordinasyon Ajansı Başkanhğı tarafindan Gagauzya Özerk Bölgesi l^omrat şehri 9601238.100 Kadastro Kodlu arsa üzerinde inşa edilen Recep Tayyip Erdoğan Türkiye Moldova Koleji'nin kurulmasına yönelik iş birliğinin hukuki temelini oluşturmaktır.

İs Birliğmin Kapsamı 1. Meslekî eğitim verilecek alanlar; Bilişim Teknolojileri ile Elektrik ve Elektronik Teknolojisi l'e j .'J 2. Recep Tayyip Erdoğan Türkiye Moldova Koleji'nde eğitim dili Romence olacaktır. Yetkili makamlar tarafindan yazılı olarak belirlenen bazı dersler Gagavuzca, Türkçe veya İngilizce dillerinde okutulacaktır. Gagavuzca veya Türkçe zorunlu ders olarak okutulacaktır. 3. Taraflar, Recep Tayyip Erdoğan Türldye Moldova Koleji yöneticileri, öğretmenler ve eğitim personeline yönelik hizmet içi eğitim faaliyetleri düzenlerler. 4. Taraflar, meslekî eğitim kurumlan arasında bilgi ve deneyimin karşıhkh olarak arttırılması amacıyla kardeş okul ilişkilerinin kurulmasını, eğitim kursu ve staj uygulamalarım teşvik ederler. 5. Recep Tayyip Erdoğan Türkiye Moldova Koleji'nin; Kolej binaları. Koleje ait tesisleri ve diğer maddi varlıklardan oluşan mal varhğı Moldova Tarafi'na ait olacak ve Türk Tarafi ile birlikte yönetilecektir. 6. Recep Tayyip Erdoğan Türkiye Moldova Koleji'nin aşağıda sıralanan hususlan, yetkili makamlarm mutabakatıyla Türkiye Cumhuriyeti'ndeki meslekî eğitim uygulamalan esas alınarak, Moldova mevzuatına uygunbir şekilde belirlenir: a) sınıfve şube sayılan, b) sınıflardaki öğrenci sayısı, c) atölye ve laboratuvar sayılan, d) malzeme ve ekiman ihtiyaçlan, e) spor salonu, pansiyon vb, müştemilatın fiziki durumu; f) öğretmen kadrosu normlan, g) ders programlan, h) öğretim programlan, i) öğretim materyalleri, 7. Taraflar, Recep Tayyip Erdoğan Türldye Moldova Koleji öğrencilerinin sosyal, kültürel, sanatsal, bilimsel ve sportif etkinliklere ve müsabakalara katılmalarım teşvik ederler ve bunlann imkânlan ölçüsünde uygulanmasım sağlarlar. 8. Taraflar, eğitim alanındaki gelişmelere yönelik konferanslar, seminerler, çalışma ziyaretleri ve bilimsel toplantılar düzenlerler. 9. ÖğrenciKabulü İşbu Protokol kapsamında Recep Tayyip Erdoğan Türkiye Moldova Kolejine yerleştirilecek öğrencilerin kabul ve kayıt kriterleri Moldova Cumhuriyeti mevzuatı ve bu Protokolün 5. Maddesinde aüfla bulunulan Yönetmelik hükümlerine göre gerçekleştirilecektir.

Hukuki Statü İşbu Protokol çerçevesinde kurulacak Recep Tayyip Erdoğan Türkiye Moldova Koleji'nin Moldova Cumhuriyeti mevzuatına göre tüzel kişilik kaydı yapılır. Recep Tayyip Erdoğan Türkiye Moldova Koleji, Moldova Cumhuriyeti Eğitim ve Araştırma Bakanhğı'na bağlı bir kamuMesleki Eğitim Kurumu - Kolej statüsüne sahiptir. Moldova Tarafi resmî makamlan veya temsilcileri Recep Tayyip Erdoğan Türkiye Moldova Koleji'nin tescil, lisans ve tanınma işlemlerini yürütür ve sürecin tamamlanmasını müteakip diplomatik kanallar aracüığıyla Türk Tarafi'nı bügilendirir. Recep Tayyip Erdoğan Türkiye MoldovaKoleji, faaliyetleriniMoldova Cumhuriyeti'ninulusal mevzuatına ve işbu Protokol'ün 5. maddesinde yer alan Yönetmeliğe uygun olaralc yürütecek ve Moldova Cumhuriyeti'ndeki muadil kurumlarmm tüm hak, yetki ve ayncahklanna sahip olacaktır. 5. Recep Tayyip Erdoğan Türkiye Moldova Koleji'nin Kolej binalan, okula ait tesisleri ve diğer maddi varlıldanndan oluşan malvarhğj, sadece işbu Protokol'ün 5. maddesinde belirtilen Yönetmelik hükümlerine uygun olarak eğitim amaçh kullanılacaktır, aksi takdirde Türk Tarafi'nın onayı gerekecektir.

Recep Tayyip Erdoğan Türkiye Moldova Koleji Yürütme Komitesi ve Yönetmeliği 1. Protokolün uygulanmasının izlenmesi ve mesleki eğitim kurumunun stratejik gelişimi için yetkili makamlar, Kolejin stratejik hedeflerine ulaşmak.-i^m^egitim politikalarım ve ■' t'' uygulamalarını değerlendirecek, okulun tanıtırm, öncelikleri, sorunları ve çözümleri için bu alanda önerilerde bulunacak bir Yürütme Komitesi kuracaktır. 2. Yürütme Komitesi, Moldova yetkili makamı tarafindan belirlenecek 2 kişi, Türkiye yetkili makamı tarafindan belirlenecek 2 kişi ve Moldova Cumhuriyeti Gagavuz Yeri Özerk Bölgesel Birimi tarafindan belirlenecek bir kişiden oluşacaktır. 3. Recep Tayyip Erdoğan Türkiye Moldova Koleji'nin yönetmelikleri, Türkiye Cumhuriyeti'nde mesleki eğitim kurumlarma uygulanan mevzuata ve Moldova Cumhuriyeti mevzuatına uygun olarak iyi uygulamalar temelinde hazırlanacalctır, 4. Recep Tayyip Erdoğan Türkiye Moldova Koleji'nin yönetmelikleri, Kolej Yönetim Kurulu tarafindan yetkili makamlarla koordine edilerek hazırlanır ve Yürütme Komitesi tarafindan onaylanır.

Eğitim Sertifika ve Belgeleri 1. Recep Tayyip Erdoğan Türkiye Moldova Koleji'nden mezun olan öğrencilere Moldova Cumhuriyeti mevzuatına göre diploma verilir. 2. Türk Tarafi, Recep Tayyip Erdoğan Türkiye Moldova Koleji tarafindan verilen diploma, transkript, sertifika ve diğer belgelerin denkliklerini tanır.

Okul Personeli 1. Recep Tayyip Erdoğan Türkiye Moldova Koleji Müdürü Moldova Cumhuriyeti mevzuatına göre atanır. Recep Tayyip Erdoğan Türkiye Moldova Koleji Eş Müdürü, Türk vatandaşı olup, Türk Tarafi tarafindan atanır. 2. Türk eş müdür, müdür yardımcıları, öğretmen ve atölye ve laboratuvar öğretmenlerinin istihdamı, ücretleri, çalışmakoşuUan ve yetkileri Türkiye Cumhuriyeti ulusalmevzuatına göre belirlenir ve ücretleri Türk Tarafinca ödenir, 3. Recep Tavvip Erdoğan Ttirldve Moldova Koleirnin İdaresi ve tsletfImesi 1. Recep Tayyip Erdoğan Türkiye Moldova Koleji'nin yönetimi ve işletimi bir Yönetim Kurulu tarafindan yürütülür, 2. Yönetim Kurulu üyeleri arasında Müdür, Eş Müdür, Müdür Yardımcıları, Moldova Cumhuriyeti Gagavuz Yeri Özerk Bölgesi temsilcisi ve Kolej Yönetmeliği ile belirlenen diğer üyeler yer alır, 3. Recep Tayyip Erdoğan Türkiye Moldova Koleji yöneticilerinin, öğretmenlerinin, öğrencilerinin ve diğer personelinin işletmelerde beceri eğitimi, hizmet içi eğitim, sosyal, kültürel, sanatsal, bilimsel, sportif faaliyetler ve yanşmalara katılmak üzere Türkiye Curnhuriyeti'ne gönderilmeleri halinde seyahat ve sağlık sigortası ile yol masrafları; yemek ve konaklama masrafları ise Moldova Tarafı veya Türk Tarafi tarafindan karşılanacaktır, 8. Türkiye Cumhuriyeti tarafindan görevlendirilen idareci ve öğretmenler ile bunların himayesi altmdaki aile fertlerine Moldova Cumhuriyeti'nde yürürlükte olan mevzuata göre ücretsiz çalışma vizesi ve oturma izni verilmesini sağlamak. Söz konusu kişiler, hizmetler için devlet vergilerinden muaftutulacaktır, 9. Türkiye Cumhuriyeti'nden Recep Tayyip Erdoğan Türkiye Moldova Koleji'nde görev yapmak üzere gönderilecek öğretmenlere ücretsiz olarak Rumence dil eğitimi vermek.

Mali Kaynaklar İşbuProtokolkapsamındaki işbirliği. Tarafların yürürlükteki ulusalmevzuatlan ve Taraflarca tahsis edilen bütçe kaynaklan çerçevesinde yürütülecektir.

Uyuşmazlıkların Cozümü îşbuProtokolün yorumlanması ve uygulanmasından doğabilecek her türlüuyuşmazlık, diplomatik kanallar aracıhğı ile karşıhkh müzakere ve dostane görüşmeler yoluyla çözülür.

Deasiklikler İşbu Protokol, Tarafların karşıhkh yazdı olarak karşıhkh mutabakatı ile herhangi bir zamanda değiştirilebilir ve eklemeler yapüabilir. Eklemeler ve değişiklikler, 15 inci maddede belirtilen usule uygunbir şeküde yürürlüğe girer ve bu Protokolün ayrılmaz bir parçası haline gelir.

Son Htikünder 1. İşbu Protokol, Tarafların andan belgenin yürürlüğe girmesi için gerekli iç yasal usullerinin tamamlandığını birbirlerine diplomatik yollarla bildirdikleri son yazdı bildirimin alındığı tarihte yürürlüğe girer. 2. İşbu Protokolün yürürlük süresi beş (5) yddır ve Taraflardan birin^bu^otokolü feshetme niyetini diğerine Protokol'ün sona ermesinden altı (6) ay önç^ıd^ İpl^ı^h^kanallardan yazdı olarak büdinmediği takdirde, beşer (5'er) yıllık süreler]^fen®^den,yen3^ir. ————V; ■ .1^ '■ A j, i-1 .i / .'i 3. Limbile gâgâuza sau turca vor fi studiate ca discipline obligatorii. 3. Pârtile vor organiza activitati de formare continua pentru personalul de conducere, profesörü şi personalul didactic al Coleginlni turco-moldovenesc Recep Tayyip Erdoğan. 4. Pârfile mcurajeaza stabilirea de relatii de îrıfi:atire şcolara, cursuri de formare şi stagü de practicâ între institutüle de învâtâmânt profesional-tehnic ale acestora, în scopul îmbunatatirü leciproce a cunoştintelor şi a schimbului de experienta. 5. Patrimoniul Colegiului turco-moldovenesc Recep Tayyip Erdoğan, format din clâdiıile Colegiului şi alte bımuri tangibüe, vor apartine Parfü moldoveneşti şi va fi administrat în comun cuPartea turca. 6. Uımâtoarele aspecte ale Colegiului turco-moldovenesc Recep Tayyip Erdoğan vor fi stabilite prin acord comun al Autoritatilor Competente, pe baza bunelor practici în învâtamântul profesional tehnic din Republica Turcia, în conformitate cu legislatia moldoveneasca: a) numârul de clase şi sectiuni; b) numârul de elevi în clase; c) numârul de ateliere şi laboratoare; ç) materiale şi echipamente necesare; d) conditiüe fîzice ale anexelor precum sala de sport, camin ete.; e) normele pentru personalul didactic; f) programele de studiu; g) cunicula; g) materiale didactice. 7. Pârlüe vor încuraja elevü Colegiului turco-moldovenesc Recep Tayyip Erdoğan sâ participe la activitati şi competifii sociale, culturale, artistice, ştiinlifice, sportive şi sâ asigure realizarea acestora în limitamijloacelor disponibüe. 8. Pârtüe vor organiza conferinte, seminare, vizite de studiu şi leuniuni ştüntifice privind evolutüle din domeniul educatiei. 9. Pârtile vor ofeıi cursuri aditionale de limbaromana şi turca elevilor-iffpjŞinül J/' a asiguranivelul necesar de pregâtire pentruprogramele de sjuâfî. .■V .. .ta t/ .• ^ 'i.* w studiupentm Articolul3 Admiterea elevilor Admiterea şi criteriile de înregistrare pentru elevii plasati în Colegiul turco-moldovenesc Recep Tayyip Erdoğan în contextul obiectivului prezentului Protocol vor fı întreprinse în conformitate cu legislatia Republicii Moldova şi Regulamentul mentionat în articolul 5 al prezentului Protocol. Articolul 4 Statutul iuridic 1. Colegiul turco-moldovenesc Recep Tayyip Erdoğan care urmeaza sa fîe Mintat prinprezentul Protocol, va fi înregistrat pentru a deveni persoanâ juridica în confomütate cu legislatia Republicii Moldova 2. Colegiul turco-moldovenesc Recep Tayyip Erdoğan va avea statut de institutie publica de învâtamânt profesional tehnic - Colegiu, subordonata Ministerului Educatiei şi Cercetârii al Republicii Moldova 3. Autoritatile Competente sau reprezentantii Pârtii Moldoveneşti vor realiza procedurile de înregistrare, licentiere şi autorizare a Colegiului turco-moldovenesc Recep Tayyip Erdoğan şi vor notifica Partea turcape canale diplomatice despre finalizarea procesului. 4. Colegiul turco-moldovenesc Recep Tayyip Erdoğan îşi va desfâşuıa activitatea în conformitate cu legislatia nationalâ a Republicii Moldova şi Regulamentul mentionat în articolul 5 al prezentului Protocol şi va dispune de toate drepturile, împutemicmle şi privilegiile institutiilor echivalente dinRepublica Moldova, 5. Activele Colegiului turco-moldovenesc Recep Tayyip Erdoğan, constând din clâdirüe Colegiului şi alte bunuri tangibile vor fi folosite numai în scopuri educationale, în conformitate cuprevederile Regulamentului mentionat la articolul 5 alprezentuluiProtocol, în caz contrar, va fi necesar acordul Pârtii türce. Articolul 5 Regulamentul si Comitetul de Conducere al Colegiului turco-moldovenesc Recep Tayyip Erdoğan 1. Pentru monitorizaıea implementârii Protocolului şi pentru ^zvoltarea. ştrategica a învâtâmântului profesional tehnic în institutie, Autoritatile Competente vor crear^ufConıitet de .Jİ/ ~ Conducere, care va evalua politicile educationale şi practicilp^p^ntiııVaı o 5.' I y ^ ^ tl strategice ale Colegiulııi, va face recomandari în acest domeniu pentru promovarea şcolii, prioritâtilor, examinareaproblemelor şi solutiilor. 2. Comitetul de Conducere va fi creat din douâ persoane detenninate de catre Autoritâtile Competente ale Pârtii moldoveneşti, doua persoane determinate de catre Antoritajile Competente ale Pârtii türce şi o persoanâ determinata de catre unitatea teritorialâ autonomâ Gâgâuzia a Republicii Moldova. 3. Regulamentul Colegiului turco-moldovenesc Recep Tayyip Erdoğan va fi elaborat în corespundere cubunele practici în conformitate culegislatia aplicabilâinstituîiilor de învâtâmânt profesional tehnic din Republica Turcia şi în conformitate cu legislatia Republicii Moldova. 4. Regulamentul Colegiului turco-moldovenesc Tayyip Erdoğan va fi elaborat de catre Consiliul de Adnıinistratie al Colegiului, coordonat cu Autoritatüe Competente şi aprobat de Comitetul de Conducere. Artîcolul 6 Certificate şi documente educationale 1. Elevilor, absolventi ai Colegiului turco-moldovenesc Recep Tayyip Erdoğan, li se vor elibera diplome în confonnitate cu legislatia nationalâ a Republicii Moldova. 2. Partea turca va recunoaşte diplomele, foile matricole, certificatele şi alte documente efiberate de Colegiul turco-moldovenesc Recep Tayyip Erdoğan. Articolul 7 Personalul Colegiului 1. Articolul 12 Resurse financiare Cooperarea în temeiul prezentului Protocol se va desfaşura în conformitate cu legislatia nationalâ m vigoare a Pârjilor şi resursele bugetare alocate de catre Parti. Articolul 13 Solutionarea disputelor Eventualele dispute care pot apârea din inteıpretarea şi aplicarea prezentului Protocol vor fi solutionate prin consultari amiabile şinegocieri reciproce între Parti, prin canale diplomatice. Articolul 14 Amendamente Prezentul Protocol poate fi amendat în orice moment prin acordul comun, în scris, al Pârtilor şi pot fi efectuate completari. Completarile şi amendamentele vor intra în vigoare în conformitate cu procedıua prevâzuta la articolul 15 al prezentului Protocol şi vor constitui parte integranta a prezentului Protocol. The assets of Recep Tayyip Erdoğan Türkiye Moldova College, consisting of College buildings, College facilities and other tangible assets, shall belong to the Moldovan Party and be co-managed with the Turkish Parly, 6. Article4 The Legal Status 1. Recep Tayyip Erdoğan Türkiye Moldova College to be established Avithin the fiamework of this Protocol, shall be registered to become a legal entity in accordance with the legislation of the Republic of Moldova, 2. Recep Tayyip Erdoğan Türkiye Moldova College shall have the status of a public Vocational EducationInstitution - College, subordinated to the Miııistry of Education and Research ofthe Republic ofMoldova, 3. Official authorities or representatives of the Moldovan Party shall cany out the registration, licensing, and authorization procedures of Recep Tayyip Erdoğan Türkiye Moldova College and shall notify the Turldsh Party tiırough diplomatic channels upon the completion of the process, 4. Recep Tayyip Erdoğan Türkiye Moldova College shall conduct its activities inaccordance with the national legislation of the Republic of Moldova and the Regulation mentioned in article 5 of the pıesent Protocol and shall have ali the rights, powers and privileges of its equivalent institutions in the Republic of Moldova, 5. Article 12 Financial resources Cooperation under this Protocol shall be carried out within the fiamework of Parties nadonal legislationin force andbudgetaıy resources allocated by the Parties. Article 13 Dispute Resolution Any disputes that may arise fiom the interpretation and application and of this Protocol shall be setded through amicable consultations and mutual negotiations and between the Parties through diplomatic channels. Article 14 Amendment This Protocol may be amended at any time by mutual agreement of the Parties in vvriting, and additions could be made. The additions and amendments shall enter into force in accordance with the procedure set forthin ArdcIe 15 and shall constitute an integral part of this Protocol. Article 15 Final Provîsions 1. This tenn is missing from the English version of the Protocpl, and its excIusion wiIİ ensure consistency between the Turkish and English versions of the text. Specifically, the repiacement of the syntagm „Republic of Tıırkey" with „Republic of Türkiye". This correction applies onİy to the English' version of ihe Turkish altemate and does nöt affect the other versions of the text; - The correction to Articİe Tl, paragraph 2 in the English version öf the Protocol is accepted. Specifically, the correction of the syntagm „equipment ensta-e" to „equipmem to ensure". This correction wiirnol entail any changes to the Romanian and Turkish versions of the text; - The correction to Articİe 11, paragraph 5 in the Turkish version of the Protocol is accepted.
