Bakır piyasası şeffaflığım artırmaya ve bakırla ilgili konularda uluslararası işbirliğini
teşvik etmeye hizmet eden ve merkezi Portekiz/Lizbon'da bulunan Uluslararası Bakır Çalışma
Grubu (UBÇG), 1987'de Birleşmiş Milletlerin sponsorluğunda bakırın dünyadaki durumunu
gözden geçirmek için düzenlenen bir dizi tavsiye toplantısının ardından 23 Ocak 1992 tarihinde
özerk bir hükümetlerarası örgüt olarak resmen kurulmuştur.
UBÇG, bakır arz ve talebini etkileyebilecek kapasite, üretim, kullanım, ticaret, stok,
fiyat, geri dönüşüm ve mevzuat konularında en doğru ve kapsamlı bilgi ve verileri üyelerine
zamanında sunmaya çalışmaktadır.
Ülkemiz, 2021 yılından itibaren gözlemci statüsünde UBÇG'nin Lizbon'daki
toplantılarma iştirak etmektedir.
Ülkemizin UBÇG'ye katılımı hususunun, bakır piyasası ile ilgili dünya çapındaki
gelişmeleri daha yakından takip edebilmek; araştırma, teknoloji transferi, sağlık, çevre, yasal
düzenlemeler ve ticaret gibi bakırla ilgili konularda üye devletlerle uluslararası işbirlikleri
geliştirmek; bakır sektörünün yönlendirilmesine ilişkin kararlarda söz sahibi olabilmek için
önemli olduğu değerlendirilmektedir.

Kuruluş
1. ^ Uluslararası Bakır Çalışma Gmbu, işbu çalışma şartnamesinin hükümlerini uygulamak
ve işleyişini denetlemek üzere kurulmuştur.
Amaç

Uluslaıarası baloı- ekonomisi haklcmda mevcut bügileri güçlendirerek ve bakır
konusunda hükümetler aıası istişareler yapılması için bir forum oluşturarak bakırla ilgili
konulai'da uluslararası işbMiğinin geliştiıilmesini sağlamalc.
Tanımlar
3.
(a) "Grup", bu çalışma şartnamesinde belirtildiği şekilde oluşturulan Uluslararası Bakır
Çalışma Gmbu anlamına gelir.
(b) "Bakır", ikincil bafar, bakır alaşımları, hurda, bafar atıklaıı ve kalmtılan, yarı maın.d
ürünler ve Grubun belirleyebileceği diğer bakır ürünleri de dahil olmak üzere rafine edilmemiş
ve rafine edilmiş bakır metal cevherleri ve konsantreleri anlamına gelir.
(e) "Üyeler", 5. fıkrada belirtilen ve 22. fıkra uyarmca kabul ettüderini bildirmiş olan
tüm Devletler ve hükümetler arası kuruluşlaı- anlamına gelir.
Görevler
4.
Amacı doğrultusunda Grup, aşağıdaki görevleri yerine getirecektir;
(a) Uluslararası bakır ekonomisi haklcmda göıüşmeler ve bİlgi alışverişi yapmak,
(b) Baku* ile ilgili istatistikleri iyileştiımek,
(c) Dünya balen endüstıisi için piyasa dui'umu ye genel görünümü hakkında gerekli
değerlendirmeleri yapmak,
(d) Grubü ilgilendiren konularda çalışmalar yürütmek,
(e) Babr pazarım geliştirmeyi ve babr talebine katkıda sağlamayı amaçlayan diğer
kuııüuşlar tarafından sürdürülen çabalarla ilgili faaliyetler üstlenmek,
(î) Uluslararası bakır ekonomisinde mevcut olan veya ortaya çıkabilecek özel sorunlai'i
veya zorlukları değerlendirmek.

tüm Devletlere ve özelUkle emtia afüâşmaları olmalc üzere uluslararası anlaşmalaım müzakere
edilmesi, akdedilmesi ve uygulanması ile. ilgili soı-umlulukları olan tüm hükümetler arası
kuruluşlara açılc olacaktır.
Grubun Yetkileri
6. (a) Grup, işbu çalışma şartnamesinde yer alan hükümlerin yerine getirilmesi ve
uygulanmasının sağlanması için gerekli olabilecek yetldleri" kullanacak ve işlemleri
gerçekleştirecek ya da bu işlemlerin gerçeldeştirilmesini sağlayacaktır.
^ (b) Gıup, doğıudan veya dolaylı olarak;, balar veya başka herhangi bir emtia veya ürün
ticareti amacıyla herhangi bir sözleşme veya vadeli işlem sözleşmesi yapma yetkisine sahip
olmayacağı gibi, bu amaçlarla herhangi bir mali yükümlülük altına girme yetkisine de sahip
olmayacaktır.
(c) Ğmp, görevleı-ini.yerine getiımekiçin gerekli olduğu düşünülen ve bu işbu çalışma
şaıtnamesine tabi olacak ve bu,şartname İle çelişmeyecek uşvd kurallarını benimseyecektir.
(d) Grap, işbu çabşma şartnamesi veya usul kürallafi kapsamı dışmda herhangi bir
yükümlülük atana girme yetkisine sahip değildir ve üyeleri tarafindan bu konuda
yetkilendirilmiş addedilmez.
Genel Merkez
7.
Grubun Genel Merkezi, Grup aksi yönde bîr karar almadıkça, bk üye Devletin
taı-aündan seçilen bk yerde olacaktır. Grup, işbu çalışma şartnamesi
yürürlüğe giıdikten sonra mümkün olan en kısa sürede akdedilmek üzere ev sahibi Hükümet ile
bir Ev Sahipliği Anlaşması müzakere edecektk.
Karar Alma Süreci
8.
(a) İşbu çalışma şartnamesi uyarınca kurulan Grubun eh geniş yetkisi Genel Kurula
verilecektir.
(b) Gıup, 9. fıkı-ada atrfta bulunulan Daimî Komite ve de kurulabilecek komiteler ve alt
organlar karmlaunı, işbu çalışma şartnamesinde veya usul .kurallarında belirli bk oylama
çoğunluğunun öngörüldüğü karaılar hariç olmak üzere, oylama yapmaksızın oybkliğiyle alır.
(c) Her üye Devlet bk oy hakkına sahip olacaktır.

(b) Grup ayrıca, katılımcı olmayan ilgili Hükümetlerle, diğer uluslararası sivil toplum
kuıuluşlarıyla veya özel sektör kuruluşlaııyla temasların sürdürülmesi için uygun gördüğü
düzenlemeleri yapabilir.
(c) Grubun veya organlanmn kararlaşürabilecegi şart ve koşullarda, Grubun veya yan
organlaıımn toplantılarına katılmak üzere gözlemciler davet edilebilir.
Ortak Fon ile İlisin
13.
Grup, Oltak Emtia Fonu'nu kuran Anlaşma'mn 7 (9) sayılı maddesi uyarınca^ bu çahşma
şaı*tnamesi hükümlerine uygun olarak, İkinci Hesap aracılığıyla Fon tarafından finanse edilecek
babr projelerine sponsorluk yapmak amacıyla Uluslaı-aı*ası Emtia Kuruluşu (ICE) olarak
ataıto^ için başvuruda bulunabilir. Butür projelerin desteklenmesine ilişkinkararlar genellikle
oybirliği ile almacaktır. Oybirliğine varılamaması halinde, kararlar üçte iki çoğunlukla
almacaktır. Grup, bu tür projelerle ilgili olarak herhangi bir malî yükümlülük altma girmeyecek
olup bu tül' herhangi bir proje için yüıütücü kuruluş olarak hareket etmeyecekti.

16 (a) Grup, aşağıdald (b) bendinde atıfta bulunulan bilgilerin yam sıra, işbu çalışma
şai-tnamesmın verımU bir şekilde uygulanması için uygun gördüğü şekilde, belirli pazarlardaki
ve nihai kullamm endüstrilerindeki tüketim de dahil olmak üzere bakırm üretimi ticareti
stokları ve tüketimine ilişkin istatistiki bügileri toplayacak, derleyecek ve üyelerine sunacaktır'
(b) Grup, iş tekı-aımı önlemek ve üretim, tüketim, stoklar, uluslararası ticaret, bakırın
uluslaı-arası kabul görmüş yayınlanmış fiyatları, teknoloji, bakırla ilgili araştumave geliştirme
faahyetlen ve bakır talebim ye arzını etkileyen diğer faktörler hakhnda güncel, güvenilir ve
eksiksiz bilgi elde edilmesini sağlamak amacıyla, katılımcı olmayan ilgili Hükümetlerle ve
uygım sivil toplum kuruluşları ve hükümetler arası kuruluşlaıla bilgi alışverişinde bulunmak
ıçm uygmı gördüğü düzenlemeleri yapacaktır.

Pazar Geliştirme
18.^ (a) Grup, üyeler arasmda ve üyeler ile bakır araştırma ve pazar geliştirme kuruluşları
gibi üçüncü taraflar arasında bakır talebini artırma ve bakır pazarını geliştirme yolları ve
araçlaıı hakkında görüşmeler yapacaktır. Bu çerçevede, Grup tarafından pazar gelişimini
desteklemek amacıyla yapılan çalışmalar. Grubun değerlendirmesine sunulmak üzere pazar
geliştirme projesi teklifleri hazırlarken kullanılması içhı bakır geliştirme kuruluşlaıma
dağıtılacaktır. Bu projelerin yüi'ütühnesi piyasa geliştirme kuruluşlai'i tarafından üstlenilecektir.
Grup, İkinci Hesabı aracılığıyla Ortak Fon tcirafından finanse edilecek projeleri seçebilir ve bu
projelere sponsor olabilir.
(b) Grup, piyasa geliştirme kuruluşları arasındaki koordinasyonu kolaylaştırmayı ve
piyasa gelişthme faaliyetlerinin yaygmlaştmimasım desteklemeyi teklif edecektir.
Çalışmalar
19. (a) Grup, uluslararası bakn* ekonomisi ile ilgili olarak Grup tarafından
karadaştınlabilecek belirli bir amaca yönelik çalışmaları üstlenecek veya üstlenmek İçinuygun
düzenlemeleri yapacaktır.
(b) Bu çahşmalaı- Gmba yönelilc genel tavsiyeler veya öneriler içerebilir ancak bu tür
tavsiyeler veya öneriler, her üyenin kendi ulusal babr ekonomisini tüm yönleriyle yönetme
haldcma engel teşkil etmeyecek ve diğer uluslararası örgütlerin kendi yetki alanlarma giren
konulardaki haklarına zarar vermeyecektir.
Üyelerin vüldimlülüideri
20.
Üyeler, Özellikle 16 (a) fıkrasmda atıfta bulunulan verileri sağlayarak, işbirliği yapmak
ve Grubun amacına ulaşmasını teşvik etmek için ellerinden gelen çabayı gösterirler.

en az yüzde 60'mı gerçekleştiren Devletlerin aşağıdaki (o) fib-ası uyarınca depozitere bu
çalışma şartnamesini geçici veya kesin olarak kabul ettiklerini bildirmeleriyle geçici olaıak
yürürlüğe girecektir.

(c) 5. fıkrada atıfla bulunulan ve Gruba üye olmak isteyen herhangi bir Devlet veya
hülcumetler arası kuruluş, kendi iç prosedürlerinin tamamlanmasını beklerken bu şartnameyi
geçici olarak veya kesin olarak kabul ettiğini depozitere bildirecektir. Bu çalışma şartnamesini
geçici olarak kabul ettiğini bildiren herhangi bir Devlet veya hükümetler arası kuruluş, bu
çalışma şartUEmesinin yürürlüğe girdiği tarihten veya geçici kabul bildiriminin yapıldığı
tarihten (hangisinin daha sonra olduğuna bağlı olaıak) itibaren 36 ay içinde prosedürlerini
tamamlamaya çalışacak ve bu doğrultuda depozitere bildirimde bulunacaktm Bir Devletin veya
hükümetler ması_ kuruluşun prosedürlerini yukarıda belirtilen süre içinde tamamlayamaması
halinde, Grup ilgili Devlete veya hükümetler arası kuruluşa ek süi-e tanıyabilir.
(d) Bu çahşma şartnamesinin yürürlüğe girmesi için gerekli şartlar 30 Haziran 1990
tmıhi itibariyle yerine getirilmemiş olursa depoziter, bu çalışma şartnamesini geçici veya kesin
olarak kabul ettiklerini bildirmiş olan Devletleri ve hükümetler arası kuruluşları, bu çalışma
şartnamesini geçici veya kesin olarak yürürlüğe koyup koymamaya kendi aralarmda karar
vermeye davet edecektir.
(e) Bu çalışma şartnamesi yüıürlüğe girdikten sonra depoziter, mümkün olan en kısa
sm-ede Grubun açıhş toplantısını düzenleyecektir. Mümkünse, bu toplantıdan en az bir ay önce
üyelere bılgı verilecelctir.
23.
Üyelikten Avnlma
(a) Bir üye, depozitere ve Grup Genel Sekr eterine yazılı üyelikten çekilme bildiriminde
bulunar ak herhangi bir zamanda Gruptan ayrılabilir.
(b) Aynima, ayrılan üyenin halihazırda üstlenmiş olduğu mali yükümlülüklere halel
getirmez ve ayrılma işleminin gerçekleştiği yıl için herhangi bir katkı payı iadesi hakkı vermez.
(e) Üyelikten çekilme, bildirimin depoziter tarafmdan teslim alımnasından 60 gün sonra
geçerlilik kazanır.
(d) Grubun Genel Sekreteri, bu fıkra uyarınca alman herhangi bir bildirimi her üyeye
derhal bildirecektir.
24.
Fesih
(a) Grup herhangi bir zamanda üye devletlerin üçte iki çoğunluğunun oyuyla işbu
çahşma şartnamesini feshetmeye karar verebilir. Bu şekilde yapılacak bir fesih. Grubun karar
vereceği taıih itibariyle yürürlüğe girecektir.
(b) işbu çalışma şartnamesinin feshine bakılmaksızın Grup, hesaplarm kapdtdması■'dİ -.rS\
dahil olmak üzere tasfiye faaliyetlerini yürütmek için gerekli olduğu sürşee'variiğmr.

TERMS OF REFERENCE OF THE INTERNATIONAL COPPER STÜDY GROÜP
Establishment
1.
The International Copper Study Group is hereby established to administer the
provisions and supervise the operation of these terms of reference.
Objective
2.
To ensure enhanced international co-operation on issues concsrning copper, by
improvinq the information available on the international copper economy and by
providinp a forum for interoovernmental consultations on copper.
Definitions
3.
(a)
"The Group" means the international Copper Studv Group as constituted in
these terms of reference.
(b) "Copper" means ores and concentrates of copperı unrefined and refined
copper metal, includinq secondary copperı copper alloysı serap, vastes and residues
of copperı semi-manufactured products and such other products of copper as the
Group mav determine.
(c)
"Members" means ali States and interqovernmental orqanizations as
provided for in paraaraph 5 which have notified their acceotance pursuant to
paraaraph 22.
Functions
4.
In pursuance of its obiective, the Group shall have the followinq functionsı
(a)
To Gonduct consultations and exchanaes of information on the
international copper economyı
(b)
To improve statistics on copperı
(c)
TO undertake regular assessments of the market situation and outlook for
the world copper industryı
(d)
To undertake studies on issues of interest to the Groupı
(e)
To undertake activities related to efforts pursued by other orqanizations
aimed at developina the market for copper and contributinq to the demand for copper;
(f)
To consider special problems or difficu^ties-^which exist or tnay arise in
the international cooper economy.

preiudice to the competence of other international organizatlons in matters fallino

Membership
5•
Membership of the Group shall be epen to ali States which are interested in
the production or consıamption of* or international trade in, copper, and to anv
interaovernmental organization havinq responsibilities in respect of the
neaotiation, conciusion and application of international agreements, in particular
commodity aqreements*
Powers of
the Group
6.
(a) The Group shall exercise such povrers and take action or arrange for
action to be taken as may be necessary to carry out and ensure the application of
the provisions of these terms of reference.
(b) The Group shall not have the power, directly or indirectly, to enter into
any contract for the purposes of trade in copper or in any other commodity or
pzroduct, oar anv contıract for futiıres transactions f nor shall it have the power to
enter into any financial obligations for such purposes.
(c)
The Group shall adopt such rules of procedure as are considered necessary
to carry out its functions and which shall be subject to, and not inconsistent
with, these terms of reference.
(d)
The Group shall not have the power and shall not be taken to have been
authorized bv its members to incur any obliqation outside the scope of these terms
of reference or the rules of procedure.
Headguarter s
7.
The Headauarters of the Group shall be at a location selected bv it in the
territory of a member state, unless the Group decides otherwise. The Group shall
neaotiate a Headauarters Agreement with the host Government to be conciuded as soon
as possible after these terms of reference have entered into force.
Decision^making
8.
(a)
The highest authority of the Group established under these terms of
reference shall be vested in the General Session.
(b) The Group, the Standing Committee referred to in paragraph 9, and such
committees and subsidiarv.tbpdies as may be established, shall take decisions by

consensus and without a vote, 6xcept in the case of decisions for which a specific
votinq majoıitv is specified in these terms of reference or in the rules of
procedure*
(c)
Each member State shall be entitled to one vote.
Standing Conunittee
9.
(a) The Group shall establish a Standing Committee, which shall consist of
those members of the Group which have indicated their desire to participate in its
wor3ç«
(b) The Standing Coınmittee shall undertake such tasks as mav be assigned to
it by the Group and shall reoort to the Group on completionf or on the progresSf of
its work.
Committees and subsidiary bodies
10. The Group may establish committees or other subsidiary bodies, in addition to
the Standing Conunittee, on such terms and conditions as it may determine.
Secretariat
11. (a) The Group shall have a Secretariat consisting of a Secretary-General and
such staff as may be reguired.
(b)
The Secretary-General shall be the chief administrative officer of the
Group and shall be responsible to it for the administration and operation of these
terms of reference in accordance with the decisions of the Group-
Co-operation with others

intergovernmental institutions, as appropriate.
(b)
The Group may also make arrangements as it considers appropriate for
maintaining contact with interested non-participating Governments, with other
international non-governmental organizations, or with private sector institutions,
as appropriate.
(c)
Observers may be invited to attend meetings of the Group or its
subsidiary bodies on such .terınfik^and conditions as the Group or those bodies may
decide.

Rela-tionship v/itıh the Common Fund
13. The Group may apply to be designated as an International Commodity Body (ICB)
under article 7 (9) of the Aqreeınent establishing the Common Fund for Comrnodities,
for the purpose of sponsoring, in accordance with the proyisions of these terms of
referance, projects on copper to be financed by the Fund throuph its Second
Account. Declsions on the sponsorinq of such projects shall normally be taken by
consensus.
If consensus cannot be reachedf decisions shall be taken by a
two-thirds maioritv vote. The Group shall not incur any financial obliqations in
respect of such projects> nor shall it act as executinq aqency for any such project.
Legal status
14. (a) The Group shall have legal personality. It shall/ in particular, but
subject to paragraph 6 (b) above# have the capacitv to enter into contracts, to
acguire and to dispose of movable and immovable property, and to institute legal
proceedinas•
(b)
The status of the Group in the territory of the host Government shall be
governed by a Headguarters Agreement between the host Government and the Group.
Budget contributions
15.
(a)
Each member shall contribute to an annual budget which shall be approved
by the Group in accordance with the provisions of the rules of procedure. For the
purpose of assessing the contributions of members, 50 per cent of the budget shall
be apportioned egually among them> 25 per cent shall be apportioned among member
States in proportion to their shares in the total exports and imports of member
States of copper ores and concentrates, measured in copper metal content, and
unrefined and refined copperı and the remaining 25 per cent shall be apportioned
among member States in proportion to their shares in a total vhlch shall consist of
the mine production or refined consumption of copper of each member State,
whichever is the higher.
The calculation of these shares shall be based on the
latest three calendar years for which statistics are avallable.
(b)
The Group shall determine the contribution of each member for each
financial year in a currency to be decided by the Group and in accordance with the
provisions for contributions specified in the rules of procedure.
The payment of
the contribution by each member shall be made in accordance tfith its constitutional
procedures.
(c)

Sta-fcistıics and informa-tion
16. (a)
The Group shall crollect, coilate and make available to members such
statistical information on oroduction, trade# stocks and consumption of copper#
inciudina consumption bv specific markets and end-use industries, as it deems
appropriate for the effective operation of these terms of reference, as well as the
information referred to in subparaoraph (b) below.
(b) The Group shall make such arrancjements as it considers appropriate by
which information may be exchanqed with interested non-participating Governments
and with appropriate non-governmental and interaovernmental organizations in order
to avoid duplication of work and to ensore the availability of recent, reliable and
complete information on production, consumption, stocks, international trade,
internationallv recognized published prices of copper, technology, research and
development activitles relating to copper and other factors that influence the
demand for and supply of copper*
(c)
The Group shall endeavour to ensure that information made available by it
does not pre^ludice the confidentialitv of the operations of Governments or persons
or enterprises producing, processing, marketing or consuming copper*
Annual assessment and reports
17.
(a)
The Group shall undertake an annual assessment of the world copper
situation and related matters in the light of information supplied by members and
supplemented by information from ali othe relevant sources*
The annual assessment
shall inciude a reviev of anticipated copper production capacity for future years
and an outlook for copper production, consumption and trade for the following
calendar year, for the purpose of assistina members in their individual assessments
of the evolution of the international copper economy*
(b)
The Group shall prepare a report incorporating the results of the annual
assessment and distribute it to members* If the Group deems it appropriate, this
report, as well as other reports and studies distributed to members, may be made
available to other interested parties in accordance vrith the rules of procedure*
Market development
18.
(a)
The Group shall hold discussions among members and betveen members and
third parties, such as copper research and market development organizations, on
Wâys and means of increasing the demand and developing the market for copper*
Within this fraınework the studies done by the Group in support of market
development will be disseminated to copper development organizations for their use
in preparing market development nroject proposals' to be submitted to the Group for
conaideration*
Execution of these projects will be undertaken by market
development organizations.
The Group may select and sponsor proiects to be
financed bv the Common Fund through its Second Account^

(b)
The Group shall offer to facilitate co-ordination between market
development oraanizations and support the extension of market development
activities.
Studies
19. (a) The Group shall undertake or make appropriate arranaements to undertake
ad hoc studies related to the international copper economy as mav be aqreed bv the
Group•
(b)
The studies may contain general recommendations or suggestions to the
Group but such recommendations or suggestions shall not derogate from the right of
every member to manage ali aspects of its domestic copper econonıv and shall be
without prejudice to the competence of other international organizations in matters
falling within their jurisdiction.
Obliaations of members
20.
Members shall use their best endeavours to co-operate and to promote the
âttainment of the objective of the Group, in particular by providing the data
referred to İn paragraph 16 (a).
Amendment
21.
These terms of reference may be amended only by consensus of the Group.

22.
(a)
Entry into force
These terms of reference shall enter into force definitively when States
together accoonting for at least 80 per cent of trade in copper, as set out in the
annex to these terms of reference, have notified the Secretary-General of the
ünited Nations (hereinafter referred to as "the depositarv") pursuant to
sobparagraoh (c) below of their definitive acceptance of these terms of reference.
(b)
These terms of reference shall enter into force provisionally when States
together accoonting for at least 60 per cent of trade in copper, as set out in the
annex to these terms of reference, have notified the depositary pursuant to
subparagraph (c) below of their provisional or definitive acceptance of these terms
of reference.
(c)
Any State or any intergovernmental organization referred to in
paragraph 5 which desires to become a member of the Group shall notify the
depositary that it accepts these terms of reference either provisionally, pending
the conciusion of its internal procedures, or definitively. Any State or
intergovernmental organiz^a^İon-,;'iîhich has notified its provisional acceptance of

thesĞ terms of reference shall endeavour to complete its orocedures within
36 months of the date of entry into force of these terms of reference or the date
of its notification of provisional acceptance^ whichever is tiıe later/ and shall
notifv the depositary accordingiy.
Where a State or intergovernmental organization
is not able to complete its procedures within the time limit referred to above, the
Group may qrant an extension of time to the State or intergovernmental oraanization
concerned*
(d) If the reauirements for entry into force of these terms of reference have
not been met on 30 June 1990/ the depositary shall invite those States and
intercrovernmental oroanizations that have notified their provisional or definitive
acceptance of these terms of reference to decide whether or not to put these terms
of reference into force provisionally or definitiveiy amona themselves.
(e)
When these terms of reference enter into force/ the depositary shall
convene an inauqural meetinq of the Group as soon as possible thereafter, Members
shall be notified at least one month/ where possible/ prior to that meetinq.
Withdrawal
23.
(a)
A meaıber may withdraw from the Group at any time by qivinq wriüten notice
of withdrawal to the depositary and to the Secretary-General of the Group.
(b)
Withdrawal shall be without prejudice to anv financial obligations
already incurred by the withdrawinq member and shall not entitle it to any rebate
of its contribution for the year in which the withdrawai occurs,
(c)
Withârawal shall become effective 60 days after the notice is received by
the depositary.
(d)
The Secretary-General of the Group shall promptly notify each member of
any notification received under this paraqraph.
Termination
24.
(a)
The Group may at any time decide by a two-thirds majority vote of member
States to terminate these terms of reference.
Such termination shall taJce effect
on such date as the Group shall decide.
(b)
Notwithstandinq the termination of these terms of reference, the Group
shall continue in beino for as lona as it is necessary to carry out its
liquidation/ includinq the settlement of accounts.
Reservations
25.
No reservations mav be made to any of the proyisionş of these terms of
reference.

MANDATO DEIı GRUPO INTERNACIONAL DE ESTUDIO SOBRE EL COBRE
Constitııci6n
!•
Queda constituido el Grupo Intemacional de Estudio sobre el Cobre para
dar cumplimiento a las disposiciones del presente mandato y supervisar
su apllcaci6n,
Objetivo.
2.
Intensificar la cooperacion intemacional en las cuestiones relativas al
cobre, mejorando la informacion disponible sobre la econom£a intemacional del
cobre y sirviendo de marco para celebrar consultas intergubernamentales sobre
el cobre.
Definiciones
3.
a)
Por "el Grupo" se entiende el Grupo intemacional de Estudio sobre
el Cobre constituido por el presente mandato.
b)
Se entiende por "cobre" los minerales y concentrados de cobre/ el cobre
metal en bruto y refinado, inciuido el cobre secundario) las aleaciones de cobre;
la chatarra, los desechos y los residuos de cobre; las semimanufacturas y los
demSs productos de cobre gue detennine el Grupo.
c)
Se entiende por "miembros" todos los Estados y organizaciones
intergubernamentales a gue se refiere el pârrafo 5 c[ue hayan notificado su
aceptaciön de confonnidad con el pârrafo 22.
Funciones
4.
Pcira la consecucion de su objetivo el Grupo desempenarâ las funciones
siguientest
a)
Organizar consultas e intercambios de informacion sobre la economıa
intemacional del cobre;
b)
Mejorar las estadisticas sobre el cobre;
c)
Bvaluar regularmente la situaciön del mercado y las perspectivas de la
industria mundial del cobre;
d)
Realizar estudios sobre cuestiones de interes para el Grupo;
e)
Emprender actividades en relacion con los esfuerzos realizados por otras
organizaciones para desarrollar el mercado del cobre y contribuir a la demanda
de cobre;

Exaıııinar los probleıtıas o dificultades especiales q[ue existan o puedan
surgir en la economla internacional del cobre*
El Grupo desempeîîarâ las funciones arriba enumeradas sin menoscabo del derecho de
cada miembro a administrar todos los aspectos de su economia nacional del cebre y
sin perjuicio de la competencia de otras organizaciones internacionales en las
cuestiones comprendidas en el Imbito de su jurisdicciön.
Composicion
5.
Podrân ser miembros del Grupo todos los Estados interesados en la
producciön o el consumo de cobre o en el comercio internacional del cobre y toda
organizaciön intergubernamental con competencia para la negociacion, la
celebracion y la aplicacion de acuerdos internacionales^ en particular convenios
internacionales de prcductos bâsicos,
Facultades del Grupo
6.
a)
El Grupo ejercerâ las facultades y tomara o hara que se tomen las
medidas que sean necesarias para dar cumplimiento a las disposiciones del presente
mandato y velar por su aplicaciön.
b)
El Grupo no estarâ facultado, directa ni indirectamente/ para concertar
ningön contrato relativo al comercio del cobre o de cualguier otro producto/
bâsico o de otra naturaleza, ni ningûn contrato sobre operaciones de futuros?
tampoco estarâ facultado para contraer obligaciones financieras con tales fines.
c)
El Grupo aprobarâ el reglamento que considere necesario para el
desempeno de sus funciones, sin perjuicio de lo dispuesto en el presente mandato,
al gue deberâ ser conforme ese reglamento,
d)
El Grupo no estarâ facultado ni se entenderâ que haya sido autorizado .
por sus miembros para contraer ninguna obligacion que exceda del âmbito del
presente mandato o del reglamento.
S ede
7.
La sede del Grupo estarâ situada en el lugar que âste elija en el
territorio de un Estado miembro, a menos que el Grupo decida otra cosa. El Grupo
negociarâ con el gobiemo del pais huesped un acuerdo de sede que se concertarâ lo
antes posible despues de la entrada en vigor del presente mandato.
Adopcion de decisiones
8.
a)
La autoridad suprema del Grupo constituido en virtud del presente
mandato corresponderâ a la Junta General.

b)
El Grupo, el Comite Permanente a q^e se refiere el pârrafo 9 y los
comites y örganos subsidiarios que se estsıblezcan tomarân sus decisiones por
consenso, sin someterlas a votacion, salvo las decisiones respecto de las cuales
el presente mandato o el reglamento specifigue que se adoptarSn por determinada
ıtıayorıa de votos.

Cada Estado miembro tendrâ un voto<,
Comite Permanente
9*
a)
El Grupo establecerâ un Comite Permanente que estarâ integrado por
los miembros del Grupo que hayan manifestado el deseo de participar en
sus trabajos,
b)
El Comite Permanente realizarâ las tareas que le asigne el Grupo
e informarâ a este sobre el resultado o la marcha de sus trabajos.
Comites y organos subsidiarios
10. El Grupo podrâ establecer, ademâs del Comite Permanente, otros comites
u Örganos subsidiarios en las condiciones que determine.
Secretaria
11. a)
El Grupo tendrâ una secretaria compuesta por un Secretario General
y por el personal que sea necesario.
b)
El Secretario General sera el mas alto funcionario administrativo del
Grupo y sera responsable ante el del cumplimiento y la aplicaciön del presente
mandato de conformidad con las decisiones del Grupo.
Cooperaciön con otras entidades
12. a)
El Grupo podra tomar disposiciones para celebrar consultas o
cooperar con las Naciones Unidas, sus organos o los organismos especializados
y con otras organizaciones intergubemamentales, segûn proceda.
b)
El Grupo tambien podrâ tomar las disposiciones que considere apropiadas
para mantener relaciones con los gobiernos no participantes interesados, con otras
organizaciones intemacionales no gubernamentales o con instituciones del sector
privado, segun proceda.
c)
Se podrâ invitar a observadores a que asistan a las reuniones del Grupo
o de sus organos subsidiarios en las condiciones que el Grupo o esos
organos determinen,

Relaciones con el Fondo Comûn
13. El Grupo podrâ pedir que se le designe como organismo internacional de
productos bâsicos, en virtud del pârrafo 9 del artîculo 7 del Convenio
Consti-tutivo del Fondo Comûn para los Productos Bâsicos, a fin de patrocinar,
conforme a lo dispuesto en el presente mandato, proyectos relativos al cobre que
seran financiados por el Fondo con cargo a su Segunda Cuenta. Las decisiones
concemientes al patrocinio de tales proyectos se tomarân normalmente por
consenso. De no ser posible llegar a un consenso/ las decisiones se tomarân por
mayoria de dos tercios. El Grupo no contraerâ ninguna obligaciön financiera con
respecto a tales proyectos ni actuarâ como organismo de ejecucion de ninguno de
ellos.
Estatuto jurıdico
14. a) El Grupo tendrâ personalidad jurıdica. En particular/ pero sin
perjuicio de lo dispuesto en el apartado b) del pârrafo 6 del presente mandato,
tendrâ capacidad para contratar, para adguirir y enajenar bienes muebles e
inmuebles y para litigar.
b)
El estatuto del Grupo en el territorio del paîs huesped se regirâ por el
acuerdo de sede entre el gobiemo del pais huâsped y el Grupo.
Contribucioneg al presupuesto
15. a)
Todos los miembros contribuirân a un presupuesto anual que sera
aprobado por el Grupo de conformidad con las disposiciones del reglamento. Para
determinar las contribuciones de los miembros, un 50% del presupuesto se
distribuirâ por partes iguales entre ellosj un 25% se distribuirâ entre los
Estados miembros en proporciön a la parte que corresponda a cada uno de ellos de
las exportaciones e importaciones totales de los Estados miembros de minerales y
concentrados de cobre, medidas en contenido de cobre metal, y de cobre en bruto y
refinado, y el restante 25% se distribuirâ entre los Estados miembros en
proporcion a la parte que corresponda a cada uno de ellos de un total que sera la
suma de la produccion minera o del consumo de cobre refinado, si âste es mayor, de
cada Estado miembro. El câlculo de estas partes se basara en los dltimos tres
anos civiles sobre los que se disponga de estadisticas•
b)
El Grupo determinarâ la contribucion de cada miembro para cada ejercicio
eccncmico en la moneda que decida el Grupo y de conformidad con las disposiciones
que sobre contribuciones se establezcan en el reglamento. El pago de la
contribucion de cada miembro se efectuarâ segön sus procedimientos
constitucionales.
c)
Ademâs de las contribuciones al presupuesto, el Grupo podrâ aceptar
donaciones

Estadlsticas e informacion
15. a)
El Ocupo reunirâ/ cotejarâ y comunicarâ a sus miembros las
estadîsticas sobre la producciön, el comercio, las existencias y el consuıtıo de
cobre, inciuido el consumo por mercados y por industrias de usos finales, que
juzgue apropiadas para la aplicaciön efectiva del presente mandato, ası como la
infonnaci6n a que se hace referencia en el apartado b) de este pârrafo.
b)
El Grupo tomarâ las disposiciones gue considere apropiadas para
intercambiar infontiaciön con los gobiemos no participantes interesados y con las
organizaciones intergııbernamentales y no gubemamentales pertinentes, a fin de
evitar la duplicaciön de los trabajos y de obtener datos recientes, fidedignos y
completos sobre la producciÖn, el constımo, las existencias, el comercio
intemaclonal, los precios publicados e intemacionalmente reconccidcs del cobre/
la tecnologia, las actividades de invest±gaci6n y desarrollo relativas al cobre y
otros factores que influyan en la oferta y la demanda de cobre.
c)
El Grupo velarâ por que la informaciön que proporcione no redunde en
detrimento del carâcter confidencial de las operaciones de los gobiernos o de
personas o empresas que produzcan, elaboren^ comercialicen o consuznan cobre.
Svaluaci6n anual e informes
17, a)
El Grupo realizarâ anualmente una evaluaciön de la sltuacion
mundlal del cobre y de las cuestiones conexaSr teniendo en cuenta la informacion
proporclonada por los miembros y la informaciön complementaria procedente de todas
las demâs fuentes peırbinentes • La evaluaciön anual comprenderâ un examen de la
capacidad de produccion de cobre prevista para los anos futuros y de las
perspectivas de la producciön, el consumo y el comercio de cobre para el ano civil
siguiente, a fin de ayudar a los miembros a evaluar individualmente la evoluciÖn
de la econom£a intemacional del cobre.
b)
El Grupo prepararâ un informe en el gue figuren los resultados de la
evaluaciön anual y lo distribuirâ a los miembros. Si el Grupo lo juzga apropiado,
ese informe, asî como los demas informes y estudios distribuidos a los miembros,
podrân ponerse a la disposiciön de otras partes interesadas de conformidad con
el reglamento.
Desarrollo del mercado
18. a)
El Grupo organizarâ discusiones entre los miembros y entre los
miembros y terceros, tales como los organismos de investigaciÖn sobre el cobre y
de desarrollo del mercado, sobre los medios de incrementar la demanda y
desarrollar el mercado del cobre.
Dentro de este marco, los estudios realizados
por el Grupo en apoyo del desarrollo del mercado se distribuirân a los organismos
de desarrollo del cobre para gue los utilicen al preparar las propuestas de
proyectos sobre el degarröl-lo del mercado oue habran de someterse al Grupo para

que las exaınine. La ejecucion de esos proyectos incumbirâ a los organismos de
desarrollo del mercado. El Grupo podrâ seleccionar y patrocinar los proyectos que
haya de finançlar el Fondo Comûn con cargo a sn Sagunda Cuenta-
b)
El Grupo se ofrecerâ para facilitar la ccordinacion entre los organismos
de desarrollo del mercado y para apoyar la ampliacion de las actividades de
desarrollo del mercado.
Estudios
19. a)
El Grupo efectuarâ o tomara las disposiciones pertinentes para que
se efectûen los estudios especiales relativos a la economia intemacional del
cobre que hayan sido acordados por el Grupo.
b)
Los estudios podrSn contener recomendaciones generales o sugerencias
dirigidas al Grupo, pero tales recomendaciones o sugerencias no deberân menoscabar
el derecho de cada miembro a administrar todos los aspectos de su economİa
nacional del cobre ni redundarân en detrimento de la competencia de otras
organizaciones intemacionales en las cuestiones comprendidas en el âmbito de
su jurisdicciön.
Obligaciones de los miembros
20.
Los miembros haran todo lo posible para cooperar y para procurar el
logro del objetivo del Grupo, en particular proporcionando los datos a que se hace
referencia en el apartado a) del parrafo 16 del presente mandato.
Enmienda
21.
El presente mandato solo podrâ ser enmendado por consenso del Grupo.
Entrada en vigor
22. a)
El presente mandato entrarâ en vigor definitivamente cuando un
nümero de Estados que en conjunto representen al menos un 80% del comercio de
cobre, segön se indica en el anexo del presente mandato, hayan notificado al
Secretario General de las Naciones Unidas (denominado en lo sucesivo "el
depositario") su aceptacion definitiva del presente mandato de confoınnidad con el
apartado c) de este pârrafo.
b)
El presente mandato entrarâ en vigor provisionalmente cuando un nûmero
de Estados que en conjunto representen al menos un 60% del comercio de cobre,
segün se indica en el anexo del presente mandato, hayan notificado al depositario
su aceptacion provlsional o definitiva del presente mandato de conformidad con el
apartado c) de este pârrafo.

c)
Toc3o Estado o toda organizacion intergubernamental a que se refiere el
pârrafo 5 que desee llegar a ser miembro del Grupo notificarâ al depositario su
aceptaciön del presente mandato, bien provisionalmente, en tanfco se ultiman sus
procedimientos intemos, bien definifcivamente. Todo Estado o toda organizacion
intergubernamental que haya notificado su aceptacion provisional del presente
mandato tratarâ de ultimar sus procedimientos dentro de los 36 meses siguientes a
la fecha de la entrada en vigor del presente mandato o a la fecha de la
notificaciön de su aceptacion provisional, si âsta fuere posterior, y lo
notificarâ al depositario en consecuencia. Cuando un Estado o una organizacion
intergubernamental no pueda ultimar sus procedimientos dentro del plazo arriba
indicado, el Grupo podrâ concederle una prorroga del plazo.
d)
Si los reguisitos para la entrada en vigor del presente mandato no se
hubieren cumplido el 30 de junio de 1990, el depositario invitarâ a los Estados y
las organizaciones intergubernamentales que hayan notificado su aceptacion
provisional o definitiva del presente mandato a que decidan si lo ponen en vigor o
no entre ellos de manera provisional o definitiva.
e)
El depositario convocarâ al Grupo a su reunion inaugural lo antes
posible despues de la entrada en vigor del presente mandato. De ser posible, la
reuniön serâ notificada a los miembros por lo menos con un mes de antelaciön,
Retiro
23. a)
Todo miembro podrâ retirarse del Grupo en cualguier momento
notificando su retiro por escrito al depositario y al Secretario General del Grupo.
b)
El retiro de un miembro no le exonerarâ de ninguna obligaciön financiera
gue hubiere contraıdo ni le dara derecho a ninguna reduccion de su contribuciön
correspondiente al ano en quG se produzca el retiro.
c)
El retiro surtirâ efecto 60 dxas despues de gue el depositario reciba
la notificacion.
d)
El Secretario General del Grupo notificarâ sin demora a cada miembro
cualguier notificacion gue reciba con arreglo a este pârrafo,
Terminaci6n
24. a)
El Grupo podrâ en cualguier momento decidir, por mayorıa de dos
tercios de los Estados miembros, dar por terminado el presente mandato, Esa
terminacion surtirâ efecto en la fecha gue decida el Grupo.

Creation
1.
Le Groupe d'etüde international du cuivre est cree par les presents Statuts
pour en mettre en oeuvre les dispositions et en surveiller l'application-

2.
Accroitre la cooperation internationale au sujet des problemes du cuivre,
en ameliorant 1'information disponible sur l'economie internationale du cuivre et
en servant de cadre pour des consultations intergouvernementales sur le cuivre.
Definitions
3.
a)
L'expression "le Groupe" designe le Groupe d'etude international du cuivre
cree par les presents Statuts.
b)
Le terme "cuivre" recouvre : les minerais et concentres de cuivre;
le cuivre metal non affine et affine, y compris le cuivre secondaire; les alliages
du cuivre; les dechets et residus de cuivre; les articles semi^manufactures et
les autres produits que le Groupe pourra definir.
c)
Par "membre" on entend tout Etat ou organisme intergouvernemental vise
au paragraphe 5 qui a notifie son acceptation conformement au paragraphe 22.
Fonctions
4.
Pour atteindre son objectif, le Groupe s'acguitte des fonctions suivantes
a)
Organiser des consultations et des echanges de renseignemenus sur
l'economie internationale du cuivre;
b)
Ameliorer les statistigues sur le cuivre;
c)
Evaluer regulierement la situation du marche et les perspectives
de l'industrie raondiale du cuivre;
d)
Faire des etudes sur des guestions qui 1'interessent;
e)
Entreprendre des activites en rapport avec les efiorts deployes
par d'autres organisations pour developper le marche du .cuivre et contribuer

de surgir dans l*economie internationale du cuivre-
Le Groupe s'acquitte des fonctions decrites ci-dessus sans porter atteinte au droit
de chaque membre de gerer tous les aspects de son secteur national du cuivre et sans
prejudice de la competence d'autres organisations internationales dans les domaines
relevant de leur mandat.
Composition
5.
Peuvent devenir membres du Groupe tous les Etats interesses par la production
ou la consoınınation de cuivre ou par le conunerce international du cuivre et tout
organisme intergouvernemental ayant competence pour la negociation, la conoiusion
et l'application d'accords internationaux, et en particulier d'accords de produit,
Pouvoirs du Groupe
6.
a)
Le Groupe exerce tous les pouvoirs et prend ou fait prendre les mesures
necessaires pour mettre en oeuvre les dispositions des presents Statuts et en assurer
1'application»
b)
Le Groupe n*est pas habilite# directement ou indirectement, â concIure
de contrat commercial sur le cuivre ou tout autre produit, ni de contrat portant sur
des operations â terme; il n'est pas nen plus habilite â contracter des obligations
financieres â ces fins.
c)
Le Groupe adopte le reglement interieur qu'il juge necessaire â
l'accoroplissement de ses fonctions, sous reserve des dispositions des presents
Statuts, auxquelles ce reglement doit etre conforme.
d)
Le Groupe n'est pas habilite et ne peut etre considere comme autorise
par ses membres a contracter des engagements en dehors du cadre des presents Statuts
ou du reglement interieur.
Siege
7.
Le Groupe a son siege en un lieu choisi par lui sur le territoire d'un Etat
membre, â moins qu'il n'en decide autrement. II negocie avec le gouvernement
du pays hote un accord de siege, conciu aussitot que possible apres l*entree
en vigueur des presents Statuts.
Prise de decisions
8.

L'autorite supreme du Groupe cree par les presents Statuts est
son Assemblee generale.

Comite permanent

a)
Le Groupe cree un Comite permanent, gui se compose des membres du Groupe
ayant exprime le souhait de pcendre part â ses travaux«
b)
Le Comite permanent s*acquitte des tâches gue le Groupe peut lui confier
et rend compte au Groupe des resultats ou des progres de ses travaux.
Comites et organes subsidiaires
10. Le Groupe peut creer des comites ou d*autres organes subsidiaires, en plus
du Comite permanent, aux conditions et selon les modalites arretees par lui.
Secretarıat
11. a)
Le Groupe dispose d'un secretariat compose d*un Secretaire general
et du personnel reguis.
b)
Le Secretaire general est le plus haut fonctionnaire du Groupe et il est
responsable devant lui de la mise en oeuvre et de l'application des dispositions
des presents Statuts conformement âux decisions du Groupe.
Cooperation avec des tiers
12.
a)
Le Groupe peut prendre des dispositions pour tenir des consultations ou
coHaborer avec 1' Organisatlon des Nablons Unles, ses organes ou les i.nstılt;ut:ions
sp^ialisees et avec d'autres organismes intergouverneraentaux, en tant gue de besoin.
b)
Le Groupe peut aussi prendre les dispositions gu'il juge appropriees
pour etablir des relations avec les gouvernements non participants interesses,
avec d*autres organisations internationales non gouvernementales ou avec
des organismes du secteur prive, en tant gue de besoin.
c)
Des observateurs peuvent etre invites a assister aux reunions du Groupe
ou de ses organes subsidiaires aux conditions et selon les modalites arretees
par le Groupe ou lesdits organes.

Relations avec le Fonds commun
13-
Le Groupe peut demander â etre designe comme organisrae international de produit,
en vertu du paragraphe 9 de 1'artide 7 de l'Accord portant creation du Fonds commun
pour les produits de baser aux fins de parrainer, conformement aux dispositions
des presents Statuts, des projets concernant le cuivre qui seront finances par
le deuxieme compte du Fonds commun. Les decisions concernant le parrainage de tels
projets sont normalement prises par consensus, S'il n'est pas possible de parvenir
â un consensus, elles sont prises a la majorite des âeux tiers des voix.
Le Groupe
ne doit contracter aucune obligation financiere pour ces projets, ni agir en qualite
d'agent d'execution pour l'un quelconque d'entre eux.
Statut juridigue
14. a)
Le Groupe a la personnalite juridigue. II a en particulier, sous reserve
des dispositions de l'alinea b) du paragraphe 6 ci'dessus, la capacite de conclure des
contrats, d'acguerir et d'aliener des biens meubles et immeubles et d'ester en justice.
b)
Le statut du Groupe sur le territoire du pays hote sera regL par un accord
de siege conciu entre le gouvernement du pays hote et le Groupe.
Contributions budgetaires
15. a}
Chaque membre contribue â un budget annuel qui est approuve par le Groupe
conformement aux dispositions du reglement interieur.
Aux fins du calcul des
contributions des membres, 50 % du budget sont repartis entre eux â parts egales;
25 % le sont entre les Etats membres â proportion de la part de chacun dans leurs
exportations et leurs importations totales de minerais et concentres de cuivre,
mesurees d'apres la teneur en cuivre metallique, et de cuivre non affine et affine;
et les 25 % restants, â proportion de la part de chaque Etat membre dans un total
constitue par les quantites de cuivre extraites ou les quantites de cuivre affine
consommees par chague Etat membre, le chiffre retenu etant le plus eleve des deux
en chague cas. Ces parts sont calculees sur les trois dernieres annees civiles
pour lesquelles des statistigues sont disponibles.
b)
Le Groupe determine la contribution de chague membre pour chague exercice
financier dans la monnaie gu'il a retenue a cette fin et conformement aux dispositions
du reglement interieur relatives aux contributions. Chague membre s'acguitte
de sa contribution suivant ses procedures constitutionnelles.
c)
En sus des contributions budgetaires, le Groupe peut accepter des dons
de sources exterieures.
Statistigues et information
16. a)
Le Groupe recueille, collige et communigue aux membres les donnees
statistigues sur la production, le commerce, les stocks et la consommation de cuivre,
y compris la consoırunation par marche et par branche d'utilisation finale, gu'il juge
necessaires â la bonne application des presents Statuts, ainsi gue les renseignements
vises â l'alinea b)

Le Groupe prend les dispositions qu'il juge necessaires pour permettre
l'echange de renseignements avec ies gouvernements non participants interesses
et avec les organisations non gouvernementales et organismes intergouvernementauK
appropriesr afin d'eviter le chevauchement des travaux et de pouvoir obtenir
des donnees recentes, fiables et completes sur la productionf la consommation,
les stocksr le coıranerce international et les prix publies et internationalement
reconnus da cuivre, sur la technologie et les activites de recherche-developpement
concernant le cuivre, ainsi que sur d'autres facteurs qui influencent la demande
et l'offre du cuivre,
c)
Le Groupe s'efforce de veliler â ce que les renseignements qu'il publie
ne portent pas atteinte au caractere confidentiel des operations des gouvernements ou
des activites de personnes ou d'entreprises qui produisent, traitent, commercialisent
ou consomraent du cuivre.
Evaluation annuelle et rapports
17.
a)
Chaque annee, le Groupe procede â une evaluation de la situation mondiale
dans le secteur du cuivre et des questions connexes, compte tenu de renseignements
fournis par les membres et d'informations complementaires provenant de toutes autres
sources appropriees. Cette evaluation annuelle comprend un exâmen de la capaclte
de production du cuivre qui est escomptee pour les annees futures et une etüde
des perspectives en ce qui concerne la production, la consommation et le commerce
de cuivre pour 1'annee çivile suivanter en vue d'aider les membres â apprecier
chacun de leur cote l'evolution de l'economie internationale du cuivre.
b)
Le Groupe etablit un rapport rendant compte des resultats de 1'evaluation
annuelle et le distribue aux membres. Si le Groupe le juge approprier ce rapport
ainsi que les autres rapports et etudes distribues aux membres peuvent etre mis
â la disposition d'autres parties interessees conformement au reglement interieur.
Developpement du marche
18. a)
Le Groupe organise des discussions entre les membres et entre les membres
et des tierSf tels que les organismes de recherche sur le cuivre et de developpement
du ınarcher concernanP les moyens d*accroître la demande de cuivre
le marche du cuivre.

A 1*interieur de ce cadre^ les etudes effectuees par le Groupe
en faveur du developpement du marche sont diffusees aupres des organismes competents
pour qu'ils puissent s'en servir pour etablir des propositions de projets relatifs
au developpement du marche devant etre soumises au Groupe pour examen. L'execution
des projets incombe aux organismes de developpement du marche.
Le Groupe peut
selectionner et parrainer des projets destines â etre finances par 1*intermediaire
du deuxieme compte du Fonds commun.
b)
Le Groupe s'emploie â faciliter la coordination entre les organismes
de developpement du marche et â appuyer l'extension des activites de developpement
du marche.

Etüdes
19. a)
Le Groupe etablit ou fait etablir les etudes speciales qu*il peut juger
appropriees au sujet de l'economie internationale du cuivre.
b)
Les etudes en question peuvent contenir des recommandations generales ou
des suggestions adressees au Grouper mais ces reconunandations ou suggestions
ne doivent pas porter atteinte au droit de chague membre de gerer tous les aspects de
son secteur national du cuivre et doivent etre faites sans prejudice de la competence
d'autres organisations internationales dans les domaines relevant de leur mandat.
Obligations des membres
20. Les membres s'emploient de leur mieux a cooperer entre eux et â promouvoir
la realisation des objectifs du Groupe^ notaınınent en conmıuniguant les donnees visees
â l'alinea a) du paragraphe 16.
Amendement
21.
Les presents Statuts ne pourront etre modifies gue par consensus du Groupe.
Entree en vigueur
22.
a)
Les presents Statuts entreront en vigueur â titre definitif lorsgue
des Etats representant ensemble 80 % au moins du commerce du cuivrer ainsi qu'il est
indigue dans l'cmnexe aux presents Statuts/ auront notifie au Secretaire general
de l'Organisation des Nations Unies (ci^apres denomme "le depositaire"),
conformement aux disposltions de l'alinea c) ci-dessous, leur acceptation definitive
des presents Statuts.
b)
Les presents Statuts entreront en vigueur â titre provisoire lorsgue
des Etats representant ensemble 60 % au moins du commerce du cuivre, ainsi qu'il est
indigue dans l'annexe aux presents Statuts, auront notifie au depositaire,
conformement aux dispositions de l'alinea c) ci-dessous, leur acceptation provisoire
ou definitive des presents Statuts.
c)
"Tout Etat ou organisme intergouvernemental vise au paragraphe 5 qui desire
devenir membre du Groupe notifie au depositaire son acceptation des presents Statuts,
solt â titre provisoire, en attendant 1'aboutissement de ses procedures internes,
soit â titre definitif.
Tout Etat ou organisme intergouvernemental qui a notifie
son acceptation provisoire des presents Statuts s'efforce de mener ses procedures
â terme dans les 36 mois suivant la date d'entree en vigueur desdits Statuts,
ou la date de sa notification, si elle est posterieure, et en fait notification

Si les conditions d'entree en vigueur des presents Statuts n*ont pas ete
remplies au 30 juin 1990, le depositaire invite les Etats et: les organismes
intergouvernenıentaux qui ont notifie leur acceptation provisoire ou definitive
des presents Statuts â decider de les mettre en vigueur ou non entre eux â titre
provisoire ou definitif.
e)
Lors de l'entree en vigueur des presents Statuts, le depositaire convogue
une reunion inaugurale du Groupe â une date aussi rapprochee que possible.
Les membres en sont avises au moins un mois, si possible, a l^avance.
Retrait
23.
a)
ün membre peut se retirer du Groupe â tout moment en notifiant son retrait
par ecrit au depositaire et au Secretaire general du Groupe.
b)
Le retrait se fait sans prejudice de tout engagement financier dejâ pris par
le membre qui se retire et ne lui donne aucun droit â une reduction de sa contribution
pour l'annee ou a lieu le retrait.
c)
Le retrait prend effet 60 jours apres que le depositaire en a reçu
notification.
d)
Le Secretaire general du Groupe informe rapidement chaque membre de toute
notification reçue en vertu du present paragraphe.
Sxtinction
24.
a)
Le Groupe peut decider â tout moment, par un vote â la majorlte
des âeux tiers des Etats membres, de mettre fin aux presents Statuts. Cette decision
prend effet a la date fixee par le Groupe.
b)
En depit de l*extinction des presents Statuts, le Groupe sera maintenu
le temps necessaire pour assurer sa liguidation, y compris l'apurement des comptes.
Reserves
25.
Aucune reserve ne peut etre apportee a une disposition quelconque des presents
Statuts.

SÖZ KONUSU DEĞİŞİKLİKLERİN METNİNİN İLETİLMESİ
Birleşmiş Milletler Genel Sekreteri, depoziter sıfatıyla
aşağıdaki hususları tebliğ eder:
Uluslararası Bakır Çalışma Grubu üyeleri, 22-26 Haziran 1992
tarihleri arasında Cenevre'de düzenlenen ilk oturumunda, uzlaşı
ile (Karar 1 (I) ), yukarıda belirtilen Şartnamenin 21. maddesi
uyarınca 13. ve 14. paragraflarını değiştirmek üzere katar
verdiler.
Depozitere, değişikliklerin yürürlüğe girmesine ilişkin olarak
15 Ağustos 1992 tarihine kadar herhangi bir itiraz ulaşmamıştır.
Bu nedenle, yukarıda belirtilen Kararın 2. paragrafı uyarınca,
13. ve 14. paragraflara yapılan değişiklikler söz konusu tarihte
yürürlüğe girmiştir.
II
Yukarıda belirtilen 1 (I) sayılı Kararın 4. paragrafı uyarınca,
söz konusu değişikliklerin Arapça, Çince, İngilizce, Fransızca,
Rusça ve İspanyolca dillerindeki metinleri bu bildirimin eki
olarak dağıtılmaktadır.
Söz konusu Kararın 5. fıkrası uyarınca, değiştirilmiş haliyle
Şartname belgesinin tasdikli nüshaları hazırlanmakta olup, en
kısa sürede yayınlanacaktır.

ULUSLARARASI BAKIR ÇALIŞMA GRUBU ŞARTNAMESİ
Kuruluş
1.
Bu şartnamenin hükümlerini uygulamak ve işleyişini denetlemek üzere Uluslararası
Bakır Çalışma Grubu kurulmuştur.
Amaç
2.
Uluslararası bakır ekonomisi hakkında mevcut bilgileri geliştirerek ve bakır
konusunda hükümetler arası istişareler için bir forum sağlayarak bakırla ilgili konularda
uluslararası iş birliğinin geliştirilmesini sağlamak.
Tanımlar
3.
(a) "Grup", bu şartname de oluşturulduğu şekliyle Uluslararası Bakır Çalışma Grubu
anlamına gelir.
(b) "Bakır" bakır cevherleri ve konsantreleri; ikincil bakır da dahil olmak üzere rafine
edilmemiş ye rafine edilmiş bakır metali; bakır alaşımları, bakır hurdaları, atıkları ve
kalıntıları; yan mamul ürünler ve Grubun belirleyebileceği diğer bakır ürünleri anlamına
gelir.
(c) "Üyeler", 5. paragrafta belirtildiği üzere, 22. paragraf uyarınca ^Jb-ull^e^i
bildirmiş olan tüm Devletler ve hükümetler arası örgütler anlamına gelir.

4.
Grup, amacına uygun olarak aşağıdaki işlevlere sahip olacaktır;
(a)
Uluslararası bakır ekonomisi hakkında istişareler ve bilgi alışverişi yapmak;
(b)
Bakır ile ilgili istatistikleri iyileştirmek;
(c)
Dünya bakır endüstrisi için piyasa durumu ve görünümüne ilişkin düzenli
değerlendirmeler yapmak;
(d)
Grubu ilgilendiren konularda çalışmalar yürütmek;
(e)
Bakır pazarını geliştirmek ve bakır talebine katkıda bulunmak amacıyla diğer
kuruluşlar tarafından sürdürülen çabalarla ilgili faaliyetlerde bulunmak;
(f)
Uluslararası bakır ekonomisinde var olan veya ortaya çıkabilecek özel
sorunları veya zorlukları değerlendirmek.
Grup yukarıdaki işlevleri, her üyenin kendi yerel bakır ekonomisinin tüm yönlerini yönetme
hakkına halel getirmeksizin ve diğer uluslararası örgütlerin kendi yetki alanlarına giren
konulardaki yetkilerine halel getirmeksizin yerine getirecektir.
Üyelik
5.
Gruba üyelik, bakır üretimi veya tüketimi ya da uluslararası ticareti ile ilgilenen tüm
Devletlere ve özellikle emtia anlaşmaları olmak üzere uluslararası anlaşmaların müzakere
edilmesi, sonuçlandırılması ve uygulanması ile ilgili sorumlulukları olan tüm hükümetler
arası kuruluşlara açık olacaktır.
Grubun Yetkileri
6.
(a) Grup, bu şartnamenin hükümlerini yerine getirmek ve uygulanmasını sağlamak
için gerekli olabilecek yetkileri kullanacak ve önlemleri alacak ya da alınmasını
sağlayacaktır.
(b) Grup, doğrudan veya dolaylı olarak, bakır veya başka bir emtia veya ürün ticareti
amacıyla herhangi bir sözleşme veya gelecekteki işlemler için herhangi bir sözleşme yapma
yetkisine sahip olmayacaktır; bu tür amaçlar için herhangi bir mali yükümlülük altına girme
yetkisine de sahip olmayacaktır.

(c)
Grup, görevlerini yerine getirmek için gerekli olduğu düşünülen ve bu
şartnameye tabi olan ve onunla çelişmeyen usul kurallarını kabul eder.
(d)
Grup, bu şartname veya usul kuralları kapsamı dışında herhangi bir
yükümlülük altına girme yetkisine sahip değildir ve üyeleri tarafından yetkilendirilmiş
olarak kabul edilmeyecektir.
Genel Merkez
7.
Grubun Genel Merkezi, Grup aksine karar vermedikçe, bir üye Devletin topraklarında
kendisi tarafından seçilen bir yerde olacaktır. Grup, bu şartname yürürlüğe girdikten sonra
mümkün olan en kısa sürede sonuçlandırılmak üzere ev sahibi Hükümet ile bir Genel Merkez
Anlaşması müzakere edecektir.
Karar verme
8.
(a) Bu şartname uyarınca kurulan Grubun en yüksek yetkisi Genel Kurul'a aittir.
(b) Grup, 9. paragrafta atıfta bulunulan Daimî Komite ve kurulabilecek komiteler ve
yardımcı organlar, bu şartnamede veya usul kurallarında belirli bir oylama çoğunluğunun
belirtildiği kararlar haricinde, kararları oylama olmaksızın uzlaşı ile alır.
(c) Her üye devlet bir oy hakkına sahiptir.
Daimî Komite
9.
(a) Grup, çalışmalarına katılmak istediklerini belirten Grup üyelerinden oluşan bir
Daimî Komite kurar.
(b) Daimî Komite, Grup tarafından kendisine verilebilecek görevleri üstlenir ve
çalışmalarını tamamladığında veya ilerleme kaydettiğinde Gruba rapor verir.
Komiteler ve yardımcı organlar
10.
Grup, Daimî Komite 'ye ek olarak, belirleyebileceği şart ve koşullarda komiteler veya
diğer yardımcı organlar kurabilir.

(a) Grup, bir Genel Sekreter ve gerekli olabilecek personelden oluşan bir Sekreterliğe
sahip olacaktır.
(b) Genel Sekreter, Grubun baş idari görevlisi olacak ve Grubun kararlarına uygun
olarak bu şartnamenin idaresi ve işleyişinden Gruba karşı sorumlu olacaktır.
Başkalarıyla is birliği
12.
(a) Grup, Birleşmiş Milletler, organları veya ihtisas kuruluşları ve diğer hükümetler
arası kuruluşlarla, uygun olduğu şekilde, istişareler veya iş birliği için düzenlemeler
yapabilir.
(b)
Grup ayrıca, katılımcı olmayan ilgili Hükümetlerle, diğer uluslararası sivil
toplum kuruluşlarıyla veya özel sektör kuruluşlarıyla irtibatın sürdürülmesi için uygun
gördüğü düzenlemeleri yapabilir.
(c)
Gözlemciler, Grubun veya bağlı organlarının toplantılarına. Grubun veya
yardımcı organların karar verebileceği şart ve koşullarda katılmak üzere davet edilebilirler.
Ortak Fon ile İlişki
13.
Grup, Emtia Ortak Fonunu kuran Anlaşmanın 7(9) maddesi uyarınca, bu şartname
hükümlerine uygun olarak. Fon tarafından İkinci Hesap aracılığıyla finanse edilecek bakırla
ilgili projelere sponsorluk yapmak amacıyla Uluslararası Emtia Organı (ICB) olarak atanmak
için başvurabilir. Bu tür projelerin desteklenmesine ilişkin kararlar normal olarak uzlaşı ile
alınacaktır. Fikir birliğine varılamaması halinde kararlar üçte iki oy çokluğuyla alınacaktır.
Grup, bu tür bir proje ile ilgili olarak herhangi bir mali yükümlülük altına girmeyecek ve
bu tür bir proje için yürütücü kuruluş olarak hareket etmeyecektir. Hiçbir üye, Grup üyeliği
nedeniyle, projelerle bağlantılı olarak başka bir üye veya kuruluş tarafından borçlanma veya
kredi verilmesinden kaynaklanan herhangi bir yükümlülükten sorumlu olmayacaktır.

Yasal statü
14.
(a) Grup uluslararası tüzel kişiliğe sahip olacaktır.
(b) Grubun ev sahibi ülke topraklarındaki statüsü, ev sahibi Hükümet ile Grup
arasında yapılacak bir Merkez Anlaşması ile düzenlenecektir.
(c) Her üyenin topraklarında ve ulusal mevzuatına tabi olarak, Grup, görevlerini
yerine getirmek için gerekli yasal ehliyete ve özellikle yukarıdaki 6(b) paragrafına tabi
olarak, sözleşme yapma, taşınır mal edinme ve elden çıkarma ve yasal işlem başlatma
ehliyetine sahip olacaktır.
Bütçe katkıları
15.
(a) Her üye, usul kuralları hükümlerine uygun olarak Grup tarafından onaylanacak
olan yıllık bütçeye katkıda bulunacaktır. Üyelerin katkı paylarının belirlenmesi amacıyla,
bütçenin yüzde 50'si üyeler arsında eşit olarak paylaştırılacak; yüzde 25'i üye devletlerin
bakır cevherleri ve konsantreleri, bakır metal içeriği cinsinden ölçülen ve rafine edilmemiş
ve rafine edilmiş bakırın toplam ihracat ve ithalatındaki paylarıyla orantılı olarak üye
devletler arasında paylaştırılacak; kalan yüzde 25'i, hangisinin daha yüksek olduğu
belirlenmek üzere, her üye devletin bakır maden üretiminden veya rafine edilmiş bakır
tüketiminden oluşan bir toplamdaki paylarıyla orantılı olarak üye devletler arasında
paylaştırılacaktır. Bu payların hesaplanmasında istatistiklerin mevcut olduğu en son üç
takvim yılı esas alınacaktır.
(b)
Grup, her üyenin her mali yıl için katkı payını, Grup tarafından
kararlaştırılacak bir para birimi cinsinden ve usul kurallarında belirtilen katkı payı
hükümlerine uygun olarak belirler. Her üye tarafından katkı payının ödenmesi, kendi
anayasal prosedürlerine uygun olarak yapılacaktır.
(c)
Bütçe katkılarına ek olarak. Grup dış kaynaklardan bağış kabul edebilir.
İstatistikler ve bilgiler
16.
(a) Grup, bakırın üretimi, ticareti, stoklan ve tüketimi hakkında, belirli pazarlar ve
nihai kullanım endüstrileri tarafından tüketim de dahil olmak üzere, bu görev tanımının
etkili bir şekilde işletilmesi için uygun gördüğü istatistiki bilgilerin yanı sıra a^ağıd-akH^
bendinde atıfta bulunulan bilgileri toplayacak, harmanlayacak ve üyelere sunae'aktır,.\

(b) Grup, mükerrer çalışmalardan kaçınmak ve üretim, tüketim, stoklar, uluslararası
ticaret, bakırın uluslararası kabul görmüş yayınlanmış fiyatları, teknoloji, bakırla ilgili
araştırma ve geliştirme faaliyetleri ve bakır talebini ve arzını etkileyen diğer faktörler
hakkında güncel, güvenilir ve eksiksiz bilgilerin mevcudiyetini sağlamak amacıyla,
katılımcı olmayan ilgili Hükümetlerle ve uygun hükümet dışı ve hükümetler arası
kuruluşlarla bilgi alışverişinde bulunmak için uygun gördüğü düzenlemeleri yapacaktır.
(c) Grup, kendisi tarafından sağlanan bilgilerin Hükümetlerin veya bakır üreten,
işleyen, pazarlayan veya tüketen kişi veya işletmelerin faaliyetlerinin gizliliğine halel
getirmemesini sağlamaya çalışacaktır.
Yıllık değerlendirme ve raporlar
17.
(a) Grup, üyeler tarafından sağlanan ve diğer tüm ilgili kaynaklardan gelen bilgilerle
desteklenen bilgiler ışığında dünya bakır durumu ve ilgili konular hakkında yıllık bir
değerlendirme yapacaktır. Yıllık değerlendirme, üyelere uluslararası bakır ekonomisinin
gelişimine ilişkin münferit değerlendirmelerinde yardımcı olmak amacıyla, gelecek yıllar
için öngörülen bakır üretim kapasitesinin gözden geçirilmesini ve bir sonraki takvim yılı
için bakır üretimi, tüketimi ve ticaretine ilişkin bir görünümü içerecektir.
(b) Grup, yıllık değerlendirmenin sonuçlarını içeren bir rapor hazırlar ve üyelere
dağıtır. Grubun uygun görmesi halinde, bu rapor ve üyelere dağıtılan diğer rapor ve
çalışmalar, usul kurallarına uygun olarak diğer ilgili tarafların erişimine sunulabilir.
Pazar Geliştirme
18.
(a) Grup, üyeler arasında ve üyeler ile bakır araştırma ve pazar geliştirme kuruluşları
gibi üçüncü taraflar arasında bakır talebini artırma ve pazarını geliştirme yollan ve araçları
hakkında görüşmeler yapacaktır. Bu çerçevede. Grup tarafından piyasa gelişimini
desteklemek amacıyla yapılan çalışmalar, değerlendirilmek üzere Gruba sunulacak piyasa
geliştirme proje tekliflerinin hazırlanmasında kullanılmak üzere bakır geliştirme
kuruluşlarına dağıtılacaktır. Bu projelerin yürütülmesi piyasa geliştirme kuruluşları
tarafından üstlenilecektir. Grup, İkinci Hesap aracılığıyla Ortak Fon tarafından finanse
edilecek projeleri seçebilir ve bunlara sponsor olabilir.
(b) Grup, piyasa geliştirme kuruluşları arasındaki koordinasyonu kolaylaştırmayı ve
piyasa geliştirme faaliyetlerinin yaygınlaştırılmasını desteklemeyi teklif edecektir.

19.
(a) Grup, uluslararası bakır ekonomisi ile ilgili olarak Grup tarafından
kararlaştırılabilecek özel amaçlı çalışmaları üstlenir veya üstlenmek için uygun
düzenlemeleri yapar.
(b) Çalışmalar Gruba genel tavsiyeler veya öneriler içerebilir, ancak bu tavsiyeler
veya öneriler her üyenin kendi bakır ekonomisini tüm. yönleriyle yönetme hakkına halel
getirmeyecek ve diğer uluslararası kuruluşların kendi yetki alanlarına giren konulardaki
yetkinliklerini zayıflatıcı nitelikte olmayacaktır.
Üyelerin yükümlülükleri
20.
Üyeler, özellikle 16 (a) paragrafında atıfta bulunulan verileri sağlayarak, iş birliği
yapmak ve Grubun amacına ulaşmasını teşvik etmek için ellerinden gelen çabayı gösterirler.
Değişiklik
21.
Bu şartname sadece Grubun ortak kararı ile değiştirilebilir.
Yürürlüğe giriş
22.
(a) Bu şartname, bu şartnamenin ekinde belirtildiği üzere, bakır ticaretinin en az
yüzde 80'ini birlikte gerçekleştiren Devletlerin aşağıdaki (c) alt paragrafı uyarınca
Birleşmiş Milletler Genel Sekreterine (bundan böyle "depoziter" olarak anılacaktır) bu
şartnameyi kesin olarak kabul ettiklerini bildirmeleriyle kesin olarak yürürlüğe girecektir. ^
(b)
Bu şartname, bu şartnamenin ekinde belirtildiği üzere, bakır ticaretinin en az
yüzde 60'ını birlikte gerçekleştiren Devletlerin, bu şartnameyi geçici veya kesin olarak
kabul ettiklerini aşağıdaki c alt paragrafı uyarınca depozitere bildirmeleriyle geçici olarak
yürürlüğe girecektir.
(c)
Gruba üye olmak isteyen herhangi bir Devlet veya 5. paragrafta atıfta
bulunulan herhangi bir hükümetler arası kuruluş, bu şartnameyi ya kendi iç prosedürlerinin
tamamlanmasına kadar geçici olarak ya da kesin olarak kabul ettiğini depozitere
bildirecektir. Bu şartnameyi geçici olarak kabul ettiğini bildiren herhangi bir Devlet veya

geçici veya kesin olarak yürürlüğe koyup koymamaya karar vermeye davet edecektir.

Bu şartname yürürlüğe girdiğinde, depoziter mümkün olan en kısa sürede
Grubun açılış toplantısını düzenleyecektir. Üyeler bu toplantıdan mümkünse en az bir ay

Çekilme
23.
(a) Bir üye, depozitere ve Grup Genel Sekreterine yazılı çekilme bildiriminde
bulunarak herhangi bir zamanda Gruptan çekilebilir.
(b) Çekilme, çekilen üyenin halihazırda üstlenmiş olduğu herhangi bir mali
yükümlülüğe halel getirmeyecek ve çekilmenin gerçekleştiği yıl için herhangi bir katkı payı
iadesi hakkı vermeyecektir.
(c) Çekilme, bildirimin depoziter tarafından alınmasından 60 gün sonra geçerli
olacaktır.
(d) Grubun Genel Sekreteri, bu paragraf kapsamında alınan her bildirimi derhal her
üyeye bildirecektir.

24.
(a) Grup herhangi bir zamanda üye devletlerin üçte iki çoğunluğunun oyuyla bu
şartnameyi feshetmeye karar verebilir. Böyle bir fesih, Grubun karar vereceği tarihte
yürürlüğe girer.
(b) Bu şartnamenin sona ermesine bakılmaksızın. Grup, hesapların kapatılması da
dahil olmak üzere tasfiyesinin gerçekleştirilmesi için gerekli olduğu sürece varlığını

TRANMISSION OF THE TEXT OF THE SAID AMENDMENTS
The Secretary-General of the United Nations, acting in
his capacity as depositary, conununicates the following:

At its inaugural session, held in Geneva from 22 to
26 June 1992, the membere of the International Copper Study
Group decided by consensus (Decision 1 (I)) to amend
paragraphs 13 and 14 of the above-mentioned Terms of
Reference pursuant to article 21 thereof.
By 15 August 1992, no objections were received by the
depositary on the entering into force of the anendments.
Therefore, in accordance with paragraph 2 of the
above-mentioned Decision, the aroendments to paragraphs 13
and 14 entered into force on that date.
II
In accordance with paragraph 4 of the above-mentioned
Decision 1 (I), the Arabic, Chinese, English, French, Russian
and Spanish versions of the said amendments are being
circulated as an annex to this notification.
In accordance with paragraph 5 of the said Decision, the
certified true copies of the Terms of Ref erence, as amended,
are being established and wi.ll be circulated as soon as
possible.

INTERNATIONAL COPPER STUDY GROUP
Establishment
1,
The Intemational Copper Study Group is hereby established to administer the
provisions and supervise the operation of these terms of reference.
Objective
2.
To ensure enhanced international co-operation on issues concerning copper» by
improving the information available on the international copper economy and by providing
a foruın for intergovemınental consultations on copper.
Detınitions
3.
(a)
"The Group" means the international Copper Study Group as constituted in
these terms of reference.
(b)
"Copper" means ores and concentrates of copper; unrefined and refined
copper metal, inciuding secondary copper; copper alloys; serap, wastes and residues of
copper; semi-manufactured products and such other products of copper as the Group
determine.
(ç)

Functions
4,
In pursuance of its objective, the Group .shall have the foilowing functions:
(a)
To conduct consultations anci exchanges of information on the international
copper economy;
(I2)
To improve statistics on copper;
(ç)
To undertake regular assessments of the market situation and outlook for the
worid copper industry;
(d)
To undertake studies on issues of înterest to the Group;
(e)
To undertake activities reiated to efforts pursued by other organizations aimed
at developing the market for copper and contributing to the demand for copper;
(f)
To consider speciai problems or difficulties which exist or may arise in the
international copper economy.
The Group shall carry out the above functions without derogating from the right of every
member to manage uil aspects of its domestic copper economy and without prejudice to the
competence of other international organizations in matters faliing within their jurisdiction.
iMemtaership
5.
Membership of the Group shail be open to ali States which are interested in the
production or consumption of, or international trade in. copper, and to any
intergovernmental organization having responsibilities in respect of the negotiation,
conciusion and application of international agreements,in particular commodity agreements.
Povvers of the Group
6.
(a) The Group shall exercise such powers and take action or arrange for action
to be taken as may be necessary to carry out and ensure the application of the provisions
of these terms of reference.
(b)

(ç) The Crcıup shall adopt such rules of procedure as are considered necessary
to carıy out its functions and vvhich shall be suhject to, and not inconsistent with, these terms
of reference.
(d)
The Group shall not have the power and shall not be taken to have been
authorized by its meınbers to incur any obligation outside the scope -of these terms of
reference or the rules of procedure.
Headguarters
7.
The Headguarters of the Group shall be at a location selected by it in the territory
of a member State, unless the Group decides otherwise.
The Group shall negotiate a
Headguarters Agreement with the host Government to be conciuded as soon as po.ssible
after these terms of reference have entered into force.
Decision-making
8.
(a)
The highest authority of the Group established under these terms of reference
shall be vested in the General Session.
(b)
The Group, the Standing Committee referred to in paragraph 9, and such
committees and subsidiary bodies as muy be established, shall take decisions by consensus
and without a vote, except in the case of decisions for which a specific voting majority is
specified in these terms of reference or in the rules of procedure.
(ç)
Each member State shall be entitled to one vote.
Standing Committee
9.
(a) The Group shall establish a Standing Committee, vvhich shall consist of those
members of the Group vvhich have indicated the ir desire to participate İn its vvork.
(b)
The Standing Committee shall undertake such tasks as may be assigned to it
by the Group and shall report to the Group on completion, or on the progress, of its vvork.
Committees and subsidiarv bodies
10.
The Group may establish committees or other subsidiary bodies, in addidomp/^^
Standing Committee, on such terms and conditions as it may determine.

Secretariat
11.
(a)
The Group shall have a Secretariat consisting of a Secretary-General and such
staff as may be required.
{b) The Secretary-Generai shall be the chief administrative officer of the Group
and shall be responsible to it for the administration and operation of these terms of
reference in accordance with the decisions of the Group.
Co-operation with others
12. (a) The Group may make arrangements for consultations or co-operation with the
United Nations, its organs or specialized agencies, and with other intergovernmenta!
institutions, as appropriate.
(b) The Group may also make arrangements as it considers appropriate for
maintaining contact with interested non-participating Governments, with other international
non-sovernmental organizations. or with prİvate sector institutions, as appropriate.
(ç)
Ohservers may be invited to attend meetings of the Group or its subsidiary
bodies on such terms and conditions as the Group or those bodies may decide.
Relationship with the Common Fund
13. The Group may apply to be designated as an international Commodity Body (ICB)
under article 7(9) of the Agreement establishing the Common Fund for Commodities, for
the purpose of sponstîring, in accordance with the provisions of these terms of reference,
projects on copper to be financed by the Fund through its Second Account. Decisions on
the sponsoring of such projects shall normally be taken by consensus. If consensus cannot
be reached, decisions shall be taken by a two-thirds majority vote. The Group shall not
incur any hnancial obligations in respect of such project; nor shall it act as executing agency
for any such project. No member shall be responsible by reason of its membership in the
Group for any liability arising from borrowing or lending by any other member or entity in
connection with projects.

Legul status
14.
(a)
The Group shall have international legal personality.
İh)
The status of the Group in the terriîory of the host country shall be governed
by a Headquarters Agreement between the host Government and the Group.
(ç)
în the territory of each member, and subject to its national legisiation. the
Group shall have the requisite legal capacity to perform its functions and in particular,
subject to paragraph 6(b) above, the capacity to enter into contracts, to acquire and to
dispose of movable property, and to institute legai proceedings.
Budget contributions
15.
(a)
Each member shall contribute to an annual budget which shall be approved
by the Group in accordance with the provisions of the ruies of procedure. For the purpose
of assessing the contributions of members, 50 per cent of the budget shall be apportioned
equally among them; 25 per cent shall be apponioned among member States in proportion
to their shares in the total exports and imports of member States of copper ores and
concentrates, measured in copper meta) content, and unrefined and refined copper; and the
remaining 25 per cent .shall be apportioned among member States in proportion to thetr
shares in a total which shall consist of the mine production or refined consumption of copper
of each member State» whichever is the higher. The caiculation of these shares shall be
based on the latesî three calendar years for which statistics are avallable.
(b) The Group shall determine the contribuiion of each member for each financial
year in a currency to be decîded by the Group and in accordance with the provisions for
contributions specified in the rules of procedure, The payment of the contribution by each
member shall be made in accordance with its constitutional procedures.
(ç)

external source.s.
Statistics and mformatıon
16.
(a)
The Group shall collect, collate and make available to members such statişticaf1^
information on production, trade, stocks and consumption of copper, including conşânıp'|i|i.ı;?^;,
by specitlc markets and end-use industries, as it deems appropriate for the|effe^n^e

(b) The Gnıup shal! make such arrangements as it considers approprîate by which
intbrmation may be exchanged with interested non-participating Governments and with
approprîate non-governmental and intergovernmental organizations in order to avoid
duplication '."'t* work and to ensure the avaiîability of recent, reliable and complete
Information on production, consumption, stocks, international irade, internatîonally
recognized published prices ot* copper. technology, research and deveiopment activities
relating to copper and other factors that intluence the demand for and supply of copper.
(ç)
The Groiıp shall endeavour to ensure that intbrmation made available by it
does not prejudice the confidentiality of the operations of Governments or persons or
enterprises producing, processing, marketing or consuming copper.
Annual assessment and reports
17.
(a)
The Group shall undertake an annual a.ssessment of the worid copper situation
and related matters in the light of information supplied by memhers and suppiemented by
intbrmation from all other relevant sources. The annual assessment shaü include a review
of anticipated copper production capacity for future years and an outlook for copper
production, consumption and trade for the füllowing calendar year. for the purpose of
assisting members in îheir individual assessments of the evolution of the international copper
economy.
(b)
The Group shall prepare a report încorporating the results of the annual
assessment and distribute it to members. If the Group deems it appropriate, this report,
as weil as other reports and studies distributed to members, may be made available tb other
interested pariies in accordance wiıh the rules of procedure.
Market deveiopment
18. (a) ' The Group shall hold discussions among members and between members and
third parties, such as copper research and market deveiopment organizations, on ways and
means of increasing the demand and developing the market for copper. Within this
framework the studies done by the Group in support of market deveiopment will be
disseminated to copper deveiopment organizations for their use in preparing market
deveiopment project propusals to be suhmitted to the Group for consideration. Execution
of these projects will be undertaken by market deveiopment organizations. The Group may
select and sponsor projects to be financed by the Common Fund through its
Account.

Studies
19. (a) The Group shall underîake or make appropriate arrangements lo undertake
ad hoc studies related to the international copper economy as may be agreed by the Group.
(b)
The studie.s maycontain general recommendations orsuggestions to the Group
bul such recommendations or suggestions shall not derogate from the right of every member
ro manage ali aspects of its dome.stic copper economy and shall be without prejudice to the
competence of other international organizations in matters falling within their jurisdiction.
OhlİLTations of members
20.
Members shall u.se their best endeavours to co-operate and to promote the
attainment of the objective of the Group, in particular by providing the data referred to in
paragraph 16 (a).
Amendment
21.
These terms of reference may be amended only by consensus of the Group.
Entrv into force
22. (a) These terms of reference shall enter into force detlnitively when States
together accounting for at least 80 per cent of trade in copper. as set out in the annex to
these terms of reference, have notified the Secretary-General ot the United Nations
(hereinafter referred to as "the depositary") pursuant to subparagraph (ç) below of their
definiıive acceptance of these terms of reference.
(b) These terms of reference shall enter into force provisionally when States
together accounting for at least 60 per cent of trade in copper, as set out in the annex to
these terms of reference, have notified the depositary pursuant to subparagraph ç below of
their provisional or definitive acceptance of these terms of reference.
(ç)
Any State or any intergovernmental organization referred to in paragraph 5
which desires to become a member of the Group shall notiiy the depositary that it accepts
these terms of reference either provisionally, pending the conciusion of its internal
procedures, or definitively. Any State or intergovernmental organization which has no|ifİGd-=^
its provisional acceptance of these terms of reference shall endeavour to
procedures within 36 months ot the date ot entry into force of these terms of re|ference^,ü^^

the depositary accordingly. Where a State or intergovernmental organizuîion is not able to
complete its procedures within the time-Iimit referred to above, the Group may grant an
extension of time to the State or intergovernmental organization concerned.
(d)
If îhe requirements tor entry into force of these terms of reference have not
been met on 30 June 1990, the depositary shall invite those States and intergovernmental
organizations that have notified their provisional or definitive acceptance of these terms of
reference to decide whether or not to put these terms of reference into force provisionally
or definitively among themselves.
(e) When these terms of reference enter into force, the depositary shall convene
an inaugural meeting of the Group as soon as possible thereafter. Members shall be
notified at least one month, where possible, prior to that meeting.
Withdrawal
23,
(a)
A member may withdraw from the Group at any time by giving written notice
of withdrawal to the depositary and to the Secretary-General of the Group.
(b) Withdrawal shall be without prejudice to any financial obiigations already
incurred by the withdrawing member and shall not entitle it to any rebate of its contribution
for the year in which the withdrawal occurs.
(ç)
Withdrawal shall become effective 60 days after the notice is received by the
depositary.
(d)
The Secretary-General of the Group shall promptly notify each member of any
notitıcîition received under this paragraph.
Termination
24.
(a)
The Group may at any time decide by a two-thirds majority vote of member
States îo terminale these terms of reference. Such termination shall take effect on such date
as the Group shall decide.
(^) Notwithstanding the termination of these terms of reference, the Group shall
continue in being for as long as it is necessary to carry out its liquidation, inciuding the
settlement of accounts.
Reservations
25.
No reservations may be made to any of the provisions of these terms ot retere|içe.

ŞARTNAMENİN 15. MADDESİNİN (a) BENDİNE İLİŞKİN DEĞİŞİKLİĞİN YÜRÜRLÜĞE GİRMESİ
Birleşmiş Milletler Genel Sekreteri, depoziter sıfatıyla aşağıdaki hususları tebliğ eder:
16-17 Mart 2005 tarihlerinde Lizbon'da düzenlenen Grubun 3. özel oturumunda, Uluslararası Bakır
Çalışma Grubu üyeleri, uzlaşı ile (Bkz. Ek B - Karar), yukarıda belirtilen şartnamenin 21. maddesi uyarınca, söz
konusu şartnamenin 15. maddesinin (a) bendini değiştirmek üzere karar verdiler. Yukarıdaki Kararın 2. paragrafına
uygun olarak, 15 (a) paragrafına yapılan değişiklik tüm taraflar için derhal yürürlüğe girmiş olup, 2006 ve sonraki
yıllara ait üye katkı paylarına uygulanacaktır.
Söz konusu Karann 4. paragrafı uyannca, kabul edilen Değişikliğin İngilizce metni ile Arapça, Çince,
Fransızca, Rusça ve İspanyolca dillerindeki metinleri bu bildirimin eki olarak dağıtılmaktadır.

24 Şubat 1989 tarihinde kabul edilen, 23 Ocak 1992 tarihinde kesin olarak yürürlüğe
giren ve daha sonra 22-26 Haziran 1992 tarihleri arasında Cenevre'de düzenlenen ilk
oturumunda Grup tarafından değiştirilen Uluslararası Bakır Çalışma Grubu'nun
Şartnamesinin bazı hükümlerinin değiştirilmesinin uygun görüldüğü,
Şartnamenin 21. paragrafına uvoun olarak.
Bu amaçla yetkilendirilmiş heyetler tarafından temsilen.

Şartnamenin 15(a) paragrafını aşağıdaki şekilde değiştirmek üzere oy birliğiyle
karar verilmiştir:
15 (a) paragrafı kaldırılarak yerine aşağıdaki hüküm getirilmiştir;
"15(a) Her üye, iç Tüzük hükümlerine uygun olarak Grup tarafından onaylanacak yıllık
bütçeye katkı payı ödeyecektir. Üyelerin katkı paylarının hesaplanmasında, bütçenin
yüzde 50'si üyeler arasında eşit olarak paylaştırılacaktır; %25'i. üye devletlerin bakır
cevheri ve konsantrelerinin toplam İhracat ve ithalatındaki paylarına, bakır metal içeriği
ile rafine edilmemiş ve rafine bakır cinsinden ölçülerek orantılı olarak üye devletler
arasında paylaştırılır; ve kalan %25'i, hangisinin daha yüksek olduğu belirlenmek üzere,
her üye devletin maden üretimi veya rafine bakır tüketiminden oluşan toplamdaki
paylarına orantılı olarak üye devletler arasında paylaştırılır. Bu payların hesaplanması,
istatistiklerin mevcut olduğu son üç takvim yılına dayalı olacaktır. Tek bir üye tarafından
ödenecek azami tutar, bütçelenen toplam katkı paylarının %10'u ile sınırlandırılacak ve
kalan tutar diğer üyeler arasında eşit olarak yeniden paylaştırılacaktır."

Ayrıca, bu değişikliğin tüm taraflar için derhal yürürlüğe girmesine ve 2006 ile
gelecek yıllar için üye katkı paylarına uygulanmasına karar verilmiştir:

Ayrıca, değişikliğin yürürlüğe girmesinden sonra Şartnameyi kabul eden herhangi
bir Devlet veya hükümetler arası kuruluşun değiştirilmiş Şartnameyi kabul etmiş
sayılması gerektiğine karar verilmiştir:

Depoziterden; değişikliği ilgili devletlere, ilgili uluslararası kuruluşlara ve
Uluslararası Bakır Çalışma Grubu Genel Sekreteri'ne iletmesi talep edilmektedir:

The Secretary-General of the United Nations, acling in his capacity as depositary,
communicates the following:
At the Group's 3"* Special session held from 16-17 March 2005 in Lisbon, the members of
the Intemational Copper Stndy Group decided by consensus(See Annex B - Decision) to amend
paragraph 15(a) of the above-mentioned Terms of Reference pursuant to article 21 thereof. In
accordance with paragraph 2 of the above Decision, the amendment to paragraph 15 (a) entered into
force for ali parties immediately and apply to member assessments for 2006 and future years.
İn accordance with paragraph 4 of the said Decision, the English versîon of the Amendment as
adopted as well as the Arabic, Chinese, Frendi, Russian and Spanish îanguage versions of the
Amendment are being circulated as an annex to ihis notification.

Annex B
Declsion
The members of Ihe İnternational Copper Studv Group
Meeting at the Group's 3*^ Special Session held from 16-17 March 2005 in Lisbon,
Gonsİdering it desirable to amend certain provislons of the Terms of Reference of the
İnternational Copper Study Group which were adopted on 24 February 1989 and
entered into force defînitively on 23 January 1992 and subsepuently amended by the
Group at its inaugural session held in Geneva from 22 to 26 June 1992,
Acting pursuant to paragraph 21 of the Terms of Reference,
Represented by delegations duly authorized for this purpose,

Decİde by consensus to amend paragraph 15 (a) of the Terms of Reference as
follovvs:
Paragraph 15 (a) is deleted and replaced by the follovving provision:
"15(3) Each member shall contribute to an annual budget which shall be approved by
the Group in accordance wlth the provisions of the Rules of Procedure. For the
purpose of assessing the contributions of members, 50 percent of the budget shall be
apportioned egually among them; 25 percent shall be apportloned among member
States in proportlon to Iheir shares in the total expoi1s and imports of member States
of copper ores and concentrates, measured İn copper metal content, and unrefined
and refined copper; and the remaining 25 percent shall be apportioned among
member States in propprtion to their shares in a total which shall consist of the mine
prodüctlon or refined consumption of ccpper of each member State, vvhichever is the
higher. The calculatlon of these shares shall be based on the iatest three caiendar
years for which statistics are available. The maximüm amount payable by an
İn'dividual member shall be capped at 10% of total budgeted assessments with the
balance redistributed egualiy across remaining members."

Decide also that thİs amendment shall enter into force for ali parties
immediately and appiy to member assessments for 2006 and future years;

Decide further that any State or intergovernmental organizatlon that accepts
the^Tenms of Reference after the entry into force of the amendment shall be deemed
to ha ve accepted the Terms of Reference as amended;
4.
Reguest the depositary to circulate the amendment to the States, international
organızations concemed and the Secretary General of the İnternational Copper Study
Group;
5.
Reguest also the depositary to establfsh and circulate certified true copies of
the Terms of Reference of the İnternational Copper Study Group as amended to the
States, the international organızations concemed and the Secretary General of the
İnternational Copper Study Group.
